My friend's puppy died! Should she take action against the breeder?? My friend got a yorkie puppy last Friday. The puppy was only 7 weeks old but the breeder ASSURED her that the puppy would be fine to leave it's mother that early. The breeder also told her that she even let one of the pups in the litter go a day before it was 6 weeks old!!!!! :eek: :eek: :eek: So, she said the 7 week old pup would be perfectly fine to go. Well, I got this email from my friend on Sunday...... Quote:

I don't think the puppy passed away because it was taken from it's mother at 7 weeks. Where I live generally puppies are taken from their mother at 6 weeks. (I'm not saying that it's right but it happens every day) It sounds like something was seriously wrong with the puppy. What did she do with the puppy? I know a lot of breeders require an autopsy in order to refund your $ or give you a new puppy. I'm so sorry for your friends loss that is incredibly sad :( |
i think legally in some states its okay at 6 or 7 weeks. and yes she let the pup go at a young age. letting her leave early doesnt sound like the problem. its sounds like something was seriously wrong with the puppy. if they couldnt rush her to an emergcy vet i would have gotten an autopsy done to see what was wrong to back up a the case. and i think they would only have a case if the breeder gave a warranty. Good luck, please keep us posted. all in all if the breeder can she should give some kind of refund or a replacement puppy if there isnt a warranty contract. if there is a contract, the puppy needed to be examed to fine what the cause was to determine if it is under the warranty (which i know sounds strange) but say the puppy eat something while her new parents glanced away and it clogged her or something, thats not going to be covered by the breeder that would be seen as the new parents fault. again good luck |
Had she taken to the vet to have it checked out? Why would she take it the puppy so early? |

She should've taken it in to have an autopsy done. I think that would be the only way she would have a case against the breeder. It would be very hard for her to prove that the breeder did know something was wrong with the pup(poor thing). Had the pup had anything el;se going on in the 9 days your friend had it? |
So Sorry :( I got mine at 3 weeks old. I took him to the vet next morning to have him checked. I was lucky that my pup was healthy he is now 8 months old. I think that if the breeder is a responsible breeder he should at least give you another puppy or a refund. So sorry for your loss. :cry: |

OMG,reading this made me cry!! It took me back a few years when exactly the same thing happened!! We didn't really know much about dogs at the time but had decided on a yorkie for many reasons. So we searched for a reputable breeder and eventually found our pup who we named Roxy.She was such a precious little thing, and she was only 6 weeks old, which at the time we thought was ok becuase alot of puppies were being sold at that age and the breeder had assured us that was normal. So we hesitantly took her and enjoyed the 2 days we had with her.It came to a very tragic end on the third day when we were woken by a very load coughing screaming sound.It was heart braking because it sounded like she was in tremendous pain.I was a shaking crying mess,but my hubby took her to the vet whilst i anxiously waited at home.They had to put her down about 5 minutes after she got to the vet.It was suspected she contracted Parvo. She just didn't stand a chance at life and it makes me so angry that this poor little thing was exposed to such a dreadful virus. I cannot believe people are selling these innocent angels to people so young, and it should be illegal.:mad: If I was your friend , I would definately be taking action! Thats exactly what we did. We had our vet write up a report on the cause of death which was dated and signed, then sent to the breeder. We were given a refund, but I will never get over what happened to Roxy. I also warned other people to avoid this breeder and advise your friend to do the same. |
I saw this blog entry on Sunday and it really saddened me. Another YT member that was concerned about the puppies after all the posts brought it to my attention We weren't going to post anything on here about it and had read it because were honestly worried a lot about these two puppies. This puppy that died belonged to NODAK who also has Tanner... this is the new little girl he had bought. I was so sad to hear that the puppy died. I wish they had taken the little girl to the vet when they woke up and saw how sick she was. |

depending on the dog, the new time for a puppy to leave is 7weeks of age. this is not the reason for this. they need to find out what happened?? did the dog fall and get hurt? was it sick?? was something stuck in throat? it could be anything. they need to find out what happened first then if necessary, go to the breeder. |

i agree 100% with Lisa on this situration question: the case with parvo, is that technically the breeders fault. its not illegal to let a pup go at 6-7 weeks, that usually not the cause of death (no vet here = ) its not like the breeder gave the pup parvo, the pup could have gotten from the vets office, from the breeders home, from the new parents home. THIS IS IF MY UNDERSTANDING IS RIGHT, CORRECT ME IF IM WRONG PEASE. because what i have learned about parvo is that someone can walk through it, and walk in to your home or yard and infect the pup if that pup has not had any vaccines. so is it really the breeders fault in that case? she technically didnt do anything wrong letting the puppy go at 6 weeks, thats just a matter of opinion really. if the breeder had the pup examed and vaccined, and the new owners took it home. then the breeder did as her part legally, right? Then she got parvo. how is it the breeders is responsible and needed to give a refund? it wasnt a genetic defect.... seriously im interested in responses on that............thanks:) |

puppy How sad! The puppy did not die due to age, it was ill. Did the puppy come to the owner with a health check and did the owner get a new puppy check from their vet after purchase? Unless, the owner takes the body to the vet and find out the cause of death, the breeder is only ethically responsible, not legally. |
I think it was a form of kennel cough that killed the puppy. Was the puppy not showing any symptoms before the day it died? I just find it hard to believe it wouldn't be. Did they not have the puppy checked by a vet after they purchased it? I'm surprised that there wouldn't be an emergency clinic around where they live. Aren't they from Nashville or some pretty large city? |
well, I wasn't going to say anything at all but seeing who the puppy belonged to has made my blood just boil. The vets almost always have emergency numbers for weekends. there are hundreds of vets in Nashville. poor little dog. never had a chance. I hope Tanner will be alright. |

I'm sorry the puppy died. I remember him asking about getting a 7 week old puppy. many warned him not to and let it stay with the breeder a little longer. the poor pup probably had kennel cough or pneumonia which of course was not their fault at all. I honestly think that Nodak and his fiancee are good people, and i have nothing against them despite what others have said here on YT. If they get the autopsy done and the vet finds something wrong that they can hold against the breeder then i think it would be all worth it. They will be refunded or get another puppy, tho in this instance i would want my money back and not another pup from this particular breeder. I know its hard to lose a baby so young. Even if the pup was only with them for 9 day i'm sure they still got attached. please send them my condolences. edit: oh and i would like to add that not all areas have emergency vets. And, even if there are quite a few emergency vets in the area not all regular vets put the number on their answering machine. I know because i have to call many vets during the course of the week. |
My biggest concern here is Tanner. If he hasn't finished his shots (and even if he has), he really needs to get checked out by the vet. They should probably exhume the body of the little female and take her also so that she can be tested. They can't really do anything about the little one who died, but they can still help Tanner. In my opinion, he needs to be their first priority. |

I would take some kind of action. I have always been told the breeders are just puppy mills if they let the babies leave any earlier than 12 weeks and to stay away from those breeders. 7 weeks is way to early. |
Poor baby. I wish he would've taken the massive amount of advice that was provided to him on YT. That would've saved a lot of pain and heartbreak. I don't think there's a case against the breeder without an autopsy and without a guarantee. I also remember him being reminded to make sure there was a good health guarantee, but that seemed to be brushed off as well... No one deserves to suffer such a loss. Chris, Heidi, and Tanner are in my prayers. |
