My friend's puppy died! Should she take action against the breeder??
 

My friend got a yorkie puppy last Friday. The puppy was only 7 weeks old but the breeder ASSURED her that the puppy would be fine to leave it's mother that early. The breeder also told her that she even let one of the pups in the litter go a day before it was 6 weeks old!!!!! :eek: :eek: :eek: So, she said the 7 week old pup would be perfectly fine to go. Well, I got this email from my friend on Sunday......

Do you think my friend could take action against the breeder for selling her a puppy this young??????

I told her to email the breeder and this is the response she got:

In my opinion, this breeder it TOTALLY negligent and should be taught a lesson for selling puppies at such a young age!! What do yall think?????

That is so sad. I know in some states it is illegal to sell them that young.

I don't think the puppy passed away because it was taken from it's mother at 7 weeks. Where I live generally puppies are taken from their mother at 6 weeks. (I'm not saying that it's right but it happens every day) It sounds like something was seriously wrong with the puppy. What did she do with the puppy? I know a lot of breeders require an autopsy in order to refund your $ or give you a new puppy.

i think legally in some states its okay at 6 or 7 weeks. and yes she let the pup go at a young age. letting her leave early doesnt sound like the problem. its sounds like something was seriously wrong with the puppy. if they couldnt rush her to an emergcy vet i would have gotten an autopsy done to see what was wrong to back up a the case. and i think they would only have a case if the breeder gave a warranty.

Good luck, please keep us posted. all in all if the breeder can she should give some kind of refund or a replacement puppy if there isnt a warranty contract. if there is a contract, the puppy needed to be examed to fine what the cause was to determine if it is under the warranty (which i know sounds strange) but say the puppy eat something while her new parents glanced away and it clogged her or something, thats not going to be covered by the breeder that would be seen as the new parents fault.

Had she taken to the vet to have it checked out? Why would she take it the puppy so early?

My friend is really suspicious that the breeder KNEW there was something wrong with the puppy because it was the LAST one left in the litter and the breeder came way off the price because she really wanted to sell it. My friend is suspicious that maybe the breeder knew something was wrong with it and that is why she came off the price so much.

There is no law in Alabama re: age that a puppy can be sold. My friend didn't know that yorkie pups should stay with their mom longer. And this was the last one left in the litter. The breeder said she would not hold the puppy any longer.

Please let your friend know that I am very sorry for their loss.

She should've taken it in to have an autopsy done. I think that would be the only way she would have a case against the breeder. It would be very hard for her to prove that the breeder did know something was wrong with the pup(poor thing). Had the pup had anything el;se going on in the 9 days your friend had it?

I got mine at 3 weeks old. I took him to the vet next morning to have him checked. I was lucky that my pup was healthy he is now 8 months old. I think that if the breeder is a responsible breeder he should at least give you another puppy or a refund.

OMG,reading this made me cry!! It took me back a few years when exactly the same thing happened!! We didn't really know much about dogs at the time but had decided on a yorkie for many reasons. So we searched for a reputable breeder and eventually found our pup who we named Roxy.She was such a precious little thing, and she was only 6 weeks old, which at the time we thought was ok becuase alot of puppies were being sold at that age and the breeder had assured us that was normal. So we hesitantly took her and enjoyed the 2 days we had with her.It came to a very tragic end on the third day when we were woken by a very load coughing screaming sound.It was heart braking because it sounded like she was in tremendous pain.I was a shaking crying mess,but my hubby took her to the vet whilst i anxiously waited at home.They had to put her down about 5 minutes after she got to the vet.It was suspected she contracted Parvo. She just didn't stand a chance at life and it makes me so angry that this poor little thing was exposed to such a dreadful virus. I cannot believe people are selling these innocent angels to people so young, and it should be illegal.:mad: If I was your friend , I would definately be taking action! Thats exactly what we did. We had our vet write up a report on the cause of death which was dated and signed, then sent to the breeder. We were given a refund, but I will never get over what happened to Roxy. I also warned other people to avoid this breeder and advise your friend to do the same.

I saw this blog entry on Sunday and it really saddened me. Another YT member that was concerned about the puppies after all the posts brought it to my attention We weren't going to post anything on here about it and had read it because were honestly worried a lot about these two puppies. This puppy that died belonged to NODAK who also has Tanner... this is the new little girl he had bought. I was so sad to hear that the puppy died. I wish they had taken the little girl to the vet when they woke up and saw how sick she was.

He knew yorkie puppies shouldn't leave the breeder that early...several members tried to tell him. I wish he had listened :(

depending on the dog, the new time for a puppy to leave is 7weeks of age. this is not the reason for this.
they need to find out what happened?? did the dog fall and get hurt? was it sick?? was something stuck in throat?
it could be anything.
they need to find out what happened first then if necessary, go to the breeder.
