refundable deposit I put a deposit down on a male Yorkie. The day before i was suppose to pick him up. I received a call from the breeder saying he was at the Vet on a IV. She said his two sister died and she thinks he has Parvo. She told me if he didn't make it she would return my deposit..He passed the next day. She sounded upset and i told her when she was ready call me and we will talk about the deposit. After a week and half i never heard anything. I called her and ask about her upcoming litters. She said she had a litter coming in Dec but, had 3 people on her waiting list. I told her since she couldn't guarantee and male i will go ahead and get my deposit back. She agreed and said she would send out that Friday..A week later nothing.So, e-mailed her for the status. She replied that the puppy died of Corona and her and husband think that with the high Vet Bill that they don't think they should send the deposit and on her sight she states the deposit is non refundable. I reminded her she told me she would send my deposit back and she said she misspoke out of grief I feel it is non refundable if i decided not to get the pup.I never had the pup in my possession..Does anyone have any suggestion on what i could do to get my deposit back..Help |
Welcome to YT. That's crazy. Yes non refundable would mean if you changed your mind. Not if the puppy died while still in her care. How much is the deposit? I would file charges in small claims court. Save all correspondence that you have with her. |
The deposit was 250.00. She keeps responding with her web site says non refundable.. |

Well is she saying that she will replace the puppy, or that you are totally SOL? I guess we all need to get a little smarter about the wording on things and get contracts that stipulate just what Non-refundable refers to. If she has not trouble selling her puppies then I can't see why she wouldn't be willing to refund your money. Plus those who were expecting puppies that died should be first in line to get the next ones. |
Well thats plain crazy. Non refundable means to me if you change your mind. The death of the dog has nothing to do with you. I can not imagine a court of law seeing it any different. I would copy the non refundable clause she has on her site. If you paid by check or money order get those records. Then I would contact her and tell her that info. If she doesnt respond like she should, tell her you will sue her if you have to. Im sure you dont want to go thru all of that, but really that is the only way to get your money back from someone like that. Good luck! |

Her site is Heavenly Yorkies threw Breeders.net. The only reason i am putting this in here so if any other buyers purshases a pup they will know if the pup dies they will not get there deposit back.. |
As I posted before. You should demand your deposit back. "Not refundable" would be if you were the one to change mind on the puppy! Could it be a scam??? :confused: |

Yes, i did fill out there complait form after i reviewed Code of Ethics..I did it yesterday. They havent responded yet..It states 1-5 days.. I e-mailed her and told her if she wasnt gonna send me my deposit i was gonna contact them..She said shes not worried she has a good reputaion..After that i filled it out..She left me no choice |

I'd like to see the wording on her website, but if you put a deposit down on a puppy, she owes you a puppy. If your puppy passed away, then your name should move to the top of the waiting list. I would take her to small claims court because she is being very unfair. Do you know for a fact whether she actually had this puppy in the first place? It might be a scam. I would ask her for the name of the vet. |

If a situation arises that I do take a deposit, I always will refund it even if the buyer backs out. I don't want my puppy going to someone that changed their mind anyway so have no reason not to return the deposit.If I have Vet bills or other money trouble, that's my problem not the problem of the buyer of my puppy. |
Yes, i drove 2.5 hours to see the pup. She did mention the Vets name in one of her e-mails but, i dont if i called they would release any information.. |
