This whole thing is crazy!!! If her wording says "if for any reason you are not able to take the pup when one is available your deposit is nonrefundable" you should not have any reason to not get your deposit back. I had a deposit on a pup to be born and the whole litter died as they were premature. The breeder called me immediately and my deposit was refunded within a few days. She offered me a choice on a new littler, but she didn't even have dogs ready to breed for another few months, so I decided to look elsewhere. If all these pups died of Corona, you might want to rethink another pup from this breeder anyway. When you are contacted by breeders.net I would let them know this as well. I know that some things are unavoidable, but this is screaming red flags at me. Keep pushing. Maybe if you make enough of nuisance, she will refund just to get rid of you! |
The same thing happened to me. My yorkied had just died. I was grieving so bad. I found a breeder on breeder.net and went to visit. She showed me a female and said she was expecting a litter and all the puppies were spoken for, but if I gave her 200.00 she would make sure I got one anyway. I waited weeks and never heard from her. I called her she wouldn't answer her phone. I emailed. She wouldn't reply. Finally, I brought in the big guns...my husband. He called and told her she could give us the puppy or send the deposit back to us. She said there weren't any puppies!!! Well, finally my husband said, look lady, I'm coming to your house to pick up my wife's deposit...she sent it right away. She is also in Indiana. Halfpint Yorkies. I want to add, I eventually met the absolute best breeder to deal with after this, she was great. Her name is Jill brooks, Muncie, Indiana. |
You sholud not just let this go. You need to send her a certified letter requesting a refund and giving all the details and giving her the exact words on her site about the non -refundable deposit, and explain to her how that does not apply to you. Tell her if you do not receive a money order, NO PERSONAL CHECK, in the mail within 7 business days, that you will file charges against her in small claims court. And then follow through. But it is important that you send a cerified letter first and keep a copy for yourself. |

have you ever met this woman or seen her breeding program? There are some really shabby breeders out there to stay away from! I dont know if I would even want a pup from her if they are sick and dying. I would take her to small claims court, it;s not your fault the pup died and was taken to the vet, thats her responsibility. |
Yes, i drove 2.5 hours to see the pup..She only had the pup out and the parents.She had a nice clean house and she was really nice..I did notice the pup on her site was not the same pup she showed me..Pup he was just as cute and small like i wanted |
I am so sorry that this has happened to you. I would also report her to AKC. I would not no how to do this but I am sure someone on here does. I hope al works out for you. God bless. |
Um. forget reporting her to breeder.net, that is secondary, you need to go to small claims and file a complaint against her. Also, sue her for filing fees as well. She has a lot of nerve and is trying to rip you off. She spent the money already and she's greedy. No excuse for that. I certainly hope you get on the ball with filing a suit in small claims against her. This is just unacceptable, period. |
I would contact an attorney for free advice. Go for more than your deposit. Make her pay court costs attorney fees, pain & suffering of not getting your baby. Plus I would contact your local news. Have them do a story on her. Non refunding policy, where does it state if the dog dies? Let other people know of this. It's one thing if they change their mind, even so if their in such high demand, she shouldn't have a problem selling them to the next one in line. What a scam. If she told everyone that she took a deposit from they died & resold them, look at the money she is making. A judge will definately side with you. |
I agree with Pipersmommy, getting a lawyer involved sounds wise. Maybe you could get him to send a harsh letter to the breeder. That often scares people and shows you're being serious about this and you're not just going away. Good luck with whatever you decide to do! |
I looked at the website that your breeder was listed under. There is a link to contact the website. I would email them and explain your situation. This breeder pays to advertise on the website and I am sure the website does not want an unethical breeder listed. You can ask their opinion, ask them to contact the breeder for you and ask that this breeder be not allowed to advertise on their site. Good luck, let me know how it turns out. Janie |

Due to a high demand for our puppies, we now require a $ 500 deposit in order to reserve a dog in an upcoming litter. If for any reason you are not able to accept a dog once one is available the deposit is non-refundable. that's off that website but a puppy is not available so you should get yopur deposit back he died point that out to her from her own site |
You should have NO problem whatsoever in getting your money back........just take her to court and add her to the bad breeders list on here. |
