I have to agree with Villette.There are breeders out there that people SHOULD be warned about..one of them is tinydarlings.I dont think this is a surprise to anyone because SO MANY people have ended up with no pup and no money,so why not warn those who are searching for a pup so that they dont make the same sad mistake as so many others before?.It took me two days to read a thread that was 13 pages long on this breeder,and I assure you that there are ALOT of people out there who are trying to get refunds with no luck.
Warning people of certain breeders is not something we do to bash any one or ruin anyones buisness because we have nothing better to do..its because we have proof that these breeders are no good,and the reason we have proof is because we know people who have had first hand experiences.I my self would apreciate any warnings if I were about to spend money on a yorkie or any breed for that matter.
Kim,I dont beleve you are an attorney either..on YF you worked at the reception in a dentist clinic,so please stop pretending you are Erin Brockovich!

Thank you for the opportunity to clarify my profession and to post some information from a legal source other than myself. I am a licensed attorney and I am a licensed to practice before all of the courts in the state of California as well as the federal and supreme courts. I graduated from law school in 1983 and have practiced law for over 20 years.

My husband is a dentist as I said on the other forum where I currently manage his two offices. I do sometimes work out front in the "reception" area. That is correct.

Erin Brokovich is not an attorney to my knowledge, unless she went to law school recently. She worked in a law office when she took on PG&E with her boss, an attorney, but thank you for the comparison. I am flattered.

Below is information that anyone can find on the internet. I did not post earlier to correct what was said by the law student because I did not want to hurt anyone's feelings by saying they were wrong and that is still not my intention. My sole intention is to educate people so they protect our yorkies and other helpless creatures in a legal manner.

Damages are "assumed" when the defamation occurs in a written form known as libel.
If you are interested the following is easily found on the internet if you search "Defamation of character proof".


Defamation is written or spoken injury to a person or organization's reputation. Libel is the written act of defamation, vs. slander, the oral act of defamation.

You often hear "Truth is the perfect defense against libel." A curious notion, not entirely supported by what goes on in the courts. Truth is a very good defense. It may prove an unshakable defense if you have $50,000 for lawyers to defend it. If you don't feel like being on the frontier of legal theory, you should build a somewhat better defense. Add on these concepts:

Avoid the impression of malice.State the facts, and then state your opinion separately. This keeps things clear in your mind.

All wrong: "My neighbor John Smith is a stinking lush." This is wildly defamatory: an unproven, malicious ("stinking" and "lush" instead of "alcoholic") statement about a private individual.
Getting better: "Governor Smith consumed 14 glasses of whiskey last night at The Watering Hole Bar. In my opinion he's an alcoholic." The proof is a bit hazy – getting drunk once does not prove alcoholism – but a governor is a public figure with less protection than John Smith, you have clearly separated fact from opinion, and there is no particular evidence of malice.
Pretty safe: "Governor Smith consumed 14 glasses of whiskey last night at The Watering Hole Bar. I wouldn't be surprised to learn he's an alcoholic." This is entirely fact, with no clear evidence of malice, about a public figure.

Slander:

A central theme through the ages has been that the reputation of the individual is of fundamental importance. Professor R. E. Brown writes in The Law of Defamation in Canada (2nd ed. 1994), at p. 1-4:
(N)o system of civil law can fail to take some account of the right to have one's reputation remain untarnished by defamation." Some form of legal or social constraints on defamatory publications "are to be found in all stages of civilization, however imperfect, remote, and proximate to barbarism.

Proving Defamation and Assessing Damages
If one can prove that one has been libelled, and there is no defence for the loss of reputation, the law assumes damages and fixes an amount as compensation. The plaintiff does not have to prove damages for actual financial loss.[/QUOTE]

okay everyone this is my opinion about this subject. i also agree that these breeders need to be stopped it is awful that thier breeding these poor yorkies this way. but i also believe that it is the responsability of the buyer to do the research on the breeder. too many buyers are looking for a "cute,tiny" yorkie and not a healthy one. it's almost like thier a fashion accessory instead of a true pet. i had mentioned in a previous thread that i did my research for literally 6 months before i got my baby. and in doing that i learned about "bad" breeders. so i figure if i can find out about these breeders anyone can. if buyers are nieve then it is because thier not really looking into this breed and doing thier homework, and they want it because thier again "cute&tiny" and because it's a trend to have a tiny dog, they want one too. i'm not by all means a yorkie know it all but i do know this if a buyer is not willing to do the research, and truly just wants a "tiny" yorkie then you have no buisness buying one! this is just my opinion.

There is a Yahoo ad running now from a breeder...10 mo old female, not 3 pounds, coming into heat. They have no qualms about selling her for breeding...what a shame.

Allright I gotta say I am a lil put off by people thinking that someone looking for a smaller yorkie is looking for a fashion accessory, or the newest fad. I personally looked for a smaller sized yorkie(approx. 4#'s). Why you ask? well because that is what I wanted. I am a responsible pet owner with references from trainers,vets,and nieghbors. I own a larger breed dog as well as other smaller animals(guineee pig) I am aware of poetential problems as I am aware of any potential problems with any pure bred dog. I did my research and found that many reputable breeders will also use the terms tinies,t-cups,micro etc... as a matter of fact I was referred to sea side yorkies from a member of this site. I found this breeder to be a wonderful person who seemed to be very caring of her lil babies. But if you go to her web site she also uses the terms that so infuriate some of you. It is just a description used to describe the size. Yes there are disreputable breeder's who do breed from small females but that does not mean you can put every breeder who uses those terms in that category. Just like you can't put all buyers of smaller dogs in the same category. If some is willing to pay a certian amt then they probably most likely have the money to pay for the medical issues that can be incurred as well. Imho way to much emphasis on terms. Use that energy on something more important like puppy mills and pet stores.

You have to admit there are many people buying these tiny dogs because they've seen a star carrying them around. My niece wanted one because Paris has one (she didn't get one!). There is nothing wrong with selling a small yorkie or buying one. Normal, healthy size yorkies have small puppies all the time. What is wrong is buying two small dogs to produce tiny puppies to make a lot of money, without any concern for their health or well being. Many people are doing just that and there are plenty of ignorant people out there to buy them. I have seen small yorkies go for $10,000.
Whenever money is involved there will be unscrupulous people just in it to make a buck.
I love this breed and I hate to see any of them suffer.

I want to apologize if my post came on strong and offends anyone its been a pretty emtional weekend (pope dying) as well as just a bad day period. I dont like to see any animal abused or thier health compromised. I just think it is unfair to assume everyone who uses those terms or that everyone looking for a smaller dog is bad or undeserving. It all comes down to responsibility of the breeder to educate in the care and potential problems and the buyer to research and educate themselves on the responsibilities of owning a pet.

there is no one party to blame it is sort of a joint effort from every one to put a stop to cruelty of animals. Thats my opinion and only an opinion. It does not mean I am right or wrong just how I feel.

[B]Sue[/B]: I think your post was right on and I agree. I think we get too caught up in the words when they are merely descriptons. Both of the breeders where I got my yorkies advertised teacups bu they were reputable and really cared about their babies. I had to convince them that I should have one of their puppies! There are lot of reasons to have a small yorkie. My dogs are service animals. They have to be small and lightweight for people with arthritus and to travel easily and be cared for easily. I am of course talking about a healthy animal. Just look at little Cosette of Cosette's Closet. She has saved her owner's life 7 times.

Yorkie Rose: That's disgusting about the 2# yorkie coming into heat for sale. What is the entity that we would report that to? Who handles anumal cruelty complaints? I don't think the AKC cares about that.

JessCruz: I totally agree with what you said too.

I think we are making a big impact on these forums. We are a large body and the information is getting out and in a widespread way. We have strength and I think as more people come here before they "buy" they will be better prepared and won't buy on impulse from a pet store or a disreputable breeder.

YAY for YORKIE TALK!! I can't wait to get my t-shirt so I can wear it around and advertise this site!!

How about t-shirts witha big red circle the word pet shop in the middle of the circle and a red line going thru it!!! :D

A pamphlet that we could make up to give out to people entering pet shops.

getting the news reporters to do a story on the horrors and heart ache of buying from a pet store.

a website where people can go to report a puppymill, and potential buyers can go to look up a potential breeder. (bad report from actual exp. or actual proof to avoid lawsuits)

I dont know I guess I can go on on with this subject. I am gonna contact some investigative news reporters out here and see if there is some way they can do a story. Its worth a try right?

Those are great ideas!! I love it. I am going to research the internet for entities who adress animal abusers. I think there is a "Stop Puppymillers" website. They may already have pamphlets and materials and we could just get them to everyone!

Sue, if you meant me, I wasn't offended. I was agreeing with you that buyers who know what to look for can get a small, healthy yorkie. It's the fact that the tinies have become so popular (and I believe it's because so many stars have them) that has opened the door to all the people only in it for the money. I was on a site with a lady that listed all tiny puppies. If she sold them all for the asking price it was over $80,000. I see her list new ones all the time.
If only healthy, small puppies were being described as a Teacup I don't think people would care. Unfortunately, that is not the case. It's all the others that get us so upset.
I think every member on this site is a dog lover and only wants the best for all of them.

I didnt mean you, I didnt mean to offend anyone that read my post and took it personally. I also agree that there are breeders doing wrong by the way do buisness and put thier dogs thru hell just to make a quick buck. I just wanted to clarify I talked to many breeders whom I thought seemed very reputable and caring (many asked me as many?'s as i asked them) that used these terms to describe thier puppies. I just think it unfair to lump all of them into one category as well as the people who buy these smaller dogs. I am just one of those of those people who tries to see things open mindedly and tries to find a solution if I can. lol (you should see my opinions when it comes to childrens issues, dont even let me get started)lol. I have sent an e-mail to the channel 5 investigative news team about pet shops and byb's I will let you know if I hear anything.
