Very Angry!!!....Reassurance Please? So.... I am sure this is a pretty "duh" thing, but I had put a deposit down on a puppy, and was supposed to be picking him up wednesday. He is about 7 months old, so he is plenty old enough to leave. She says he is only about 2.5 pounds so she asked if I could fly out and pick him up as she was not comfortable shipping him. Which I agreed to, with no hesitation. Well, today I emailed and told her my flight information, which I just spent friggin $800 on a plane ticket, only to get an email back stating that she has returned my deposit (thru paypal) and that she has another buyer picking him up tonight. Do I have any recourse? I mean, its probably the best thing, since she is proving that the almighty dollar ranks higher to her than the pups well being (she said the lady buying him is buying one of her other pups as well.) but still. I am angry..... Any advise?? |
I am not a breeder and can't offer advice but it seems kind of unethical if she had the deposit and she knew you had booked your flight. I am sorry, sometimes these things happen for a reason. I know that is hard to hear when you have your heart set on a new baby. Again, I am sorry. Is you ticket refundable? |

Did she send you a contract to sign? If not, then I think you would need to show the e-mails exchanged, to an attorney and get legal advice. I'm so sorry this happened to you. But, llike you said, it is probably for the best, since she cares more about $$$. I hope you can get your $800.00 back. That's a lot of money to lose. Sheila |
This really does suck. Are you for sure your deposit has been returned to you? Have you checked to see if your money is there? |
You do have recourse, but it is through small claims court...and you would have to sue her in her county. I would write her an email and tell her how much you are out..and tell her every time something goes wrong in her life to recall this incident...what goes around comes around...I simply ask people to treat me the way they would like to be treated...it might prick her conscinece if she has one. I did this once and the person sent me the money..said they had a miserable few months and felt they were being punished somehow...honestly it is true. |
Pat has the best advice ever, I was just wondering if you had a contract with her already. |
Where is the puppy? Did you save all your emails? Did you pay her through paypal? Did you get your money back from paypal? I would sue her through small claims court in your state for the price of the ticket. Unfortunately you can't force the breeder to sell you the puppy, even if you did put a deposit down--the breeder sounds very unethical--but I would try to talk to her on the phone and remind her that you paid for the deposit, you bought a ticket and that you want the dog, and see what the breeder says. It might not be a total loss....you might still be able to get your puppy. |
I'd be ANGRY too! I hope everything turns out better, I don't know what I'd do if it had happened to me! I hope you get your refund somehow!! |
I am so sorry that this happened to you ! I would be very angry too. Legally , you could fight her through small claims court. Just be sure you have the right docuements , and save all transactions you had , and communications you had with her. Check your paypal account if you have not done so already. |
So far she has not returned the deposit. She is now not taking my calls and its been hours. I sent her an email with proof of my ticket I purchased, and told her that I would really still like to buy the puppy. If she doesnt let me buy him, or return my deposit, or offer some kind of consolation then I am going to take her to small claims court. I am very sad, because I really want him, but now I understand why she sold him to someone else, her website said he sold for $3500 when she was going to sell him to me for $2000.... I think this all is happening for a good reason... I just dont see it yet. Oh well, time for bed. |
what a complete Witch with a capital B. you should sue her and not try to get the puppy now...forget about her and take her for all she's worth and put that horrible breeder out of as much money as you possibly can!! she's a terrible breeder. i'd tell ya to post who she is on here in the review section so we all avoid her too :( this makes me SOOO mad. |
This is the main reason I don't like the idea of having a puppy shipped. If I can't get into my car and pick up the dog I don't get involved. Although I know there are some great breeders on the internat there are always a few who ruin it for everybody. I would take her to small claims court and get my money back. |

The whole thing sucks... what does a deposit do if not 'hold' a dog? |
I am so sorry that this has happened to you.....I would email her and tell her you are contacting an attorney immediately!! This could be considered internet fraud!! What a sucky thing to do!! |

This other ladies name was Channel but I think she goes by different names. She has scammed lots of people. |
Have you contacted Paypal yet? Notify them that there is a dispute to the purchase and they can put a 'hold' on her account until the deposit is returned. I would also send them copies of the emails saying that she stated she had returned the deposit to you. |
Wow!!!!! Good morning everyone! And, it really really is! Apparently, someone here local saw this thread, about what happened, and..... she offered me one of her pups for a super good price! Almost half of what I was going to pay. This lady also just Championed out one of her dogs, and is willing to take me under her wing! I know they say bad things happen for a reason, and goodness knows I believe that, but for it to happen literally overnight?? Yay for the magic of the holidays. I am supposed to go see her pups later tonight, and I will post on here if I pick one. They arent quite ready to leave home yet, but she says she still has 3 to pick from. On the reason I posted this thread, the lady has in fact returned my deposit, but says she will not pay for my flight. My fiancee is trying to see if the airlines will either refund it or credit it for a later use.. Will let you know what happens. |

I agree with Pat (YorkieRose), you reap what you sow, so I would expect the $$ hungry breeder will get hers in due time. Thank you so much for your post!!!! Can't wait to see pics of your little darlin'. |
WOW that is wonderful news!!!! You are getting a baby :) I can see a breeder refusing sale of a pup if they choose to do so as most have it in their contract. I can NOT see doing it at that point were a flight was already scheduled. The deposit you had placed on the pup should already been returned to you. This is just so wrong on many levels :( |
I read your thread yesterday and was upset re: what was happening to you from this breeder but didnt take the time to respond. I just wanted to tell you Im glad things are looking up for you and youll be getting your pup from a reputable breeder that cares more about her dogs and her reputation than the money. Merry Christmas to you |
Glad things are working out. I would definitely pursue the cost of the plane ticket through small claims court in her jurisdiction, especially if you have in emails where she asked you to fly out there. |
Omg !!! Omg !! great news , your getting a furbaby and you got your refund !!! Most Airline if u proof to them what happen , will credit u for the ticket to be use within a year , not longer than that !!!! Pls post pictures, bark@ulater!!!! manina.miley:aimeeyorkmax:aimeeyork |
If they don't answer your calls, use someone else's phone. |
yay i'm glad ur getting a pup. that's exciting news and thanks for the kind words on my GE. Sadie is going to be just fine! :D congrats and can't wait to see the new puppy. |
2 Attachment(s) Attachment 333661Attachment 333662 these are the pictures she sent me, I am soo friggin excited to see the puppies. They are championed sired, and are being sold as pets, but she says the male has great lines so far, and if, after 7-8 months he is still looking promising, she might consider doing a co-own to show him. But only if I agree to come learn about showing from her, and attend classes and such. People, I am soo freaking giddy right now I feel like a kid at.... well Christmas!:D:D ETA: They are 9 weeks right now, but wont be ready for another 3. They have had their first shots, which is the only reason she is letting me come see them. And, the tiny picture is the male at 3 weeks, the other one is one of the females. |

Congratulations on getting a new puppy. The pictures are adorable. I was glad to read how this all is turning out. I hope you are able to get a refund for your flight. If not look at all the free mentoring you are going to get! Priceless! Merry Christmas and a Happy New Yorkie! |
