I realize that she is in breach of our contract, but she lives in a different state, do I have to file court papers there? |

I WENT ON THE AKC REGISTRATION SITE AND PUT IN THE NUMBERS THAT WERE GIVEN TO ME ON THE COPIES AND BOTH PARENTS WERE SUPPOSE TO REGISTERED BUT ONLY THE DAD CAME UP AND I NEVER GOT THE PAPERS, AND MY POOR LITTLE SAINT HAD TO BE PUT DOWN 10 DAYS AFTER I BOUGHT HIM, THE BREEDER DECIDED NOT TO HELP ME WITH THE VET BILLS, OR REIMBURME ANYTHING, SO I SUED HERE AND WON ALL MY MONEY BACK... SORRY SO LONG BUT THERE IS A POINT, WE AS BUYERS HAVE RIGHTS ITS CALLED THE PUPPY LEMON LAW, IN CALIFORNIA THE BREEDER HAS TO BE LINCENSED AND OR BE A HOBBY BREEDER, AND THEY HAVE AROUND 60 DAYS I THINK TO GIVE U THE PAPERS PROMISED OR THEY ARE IN BREECH OF CONTRAT SO THEY EITHER HAVE TO GIVE U 75% OF WHAT U PAID FOR THE DOG IF U WANT TO KEEP IT OR REIMBURSE U THE WHOLE AMOUNT, IF U SURRENDER IT, WELL WE ALL KNOW THERE OUR BABIES SO THEY CANT HAVE THEM BACK... THERE ARE RIGHTS FOR US.. WWW.PUPPYLEMONLAW.COM OR SOMETHING LIKE THAT... |
I have no use for AKC after they put me through pure he double hockey stick a few years back.. |

Wait Wait a minute. you could have been scammed but you can contact the AKC and they should tell you (if they are honest) they are WAY behind on the dna testing (you have to do this after a certain number of litters from the male) anyway... they are way behind on a lot of paperwork. I am still waiting on some myself and the dna test just came in so now we have sent in the litter information. They are behind more than they have ever been according to a few breeders. So, you could be getting the run around but it also could be that. |
The puppy you got is called a "breeder back" puppy, I believe. It's fairly common to get a puppy from a litter instead of a stud fee. Since your puppy came with limited registration, I assume there was also a spay/neuter agreement. Most reputable breeders will hold the papers until receiving proof of the spay or neuter. If you dealt with a reputable breeder, all this is routine and you shouldn't have any problem getting the papers. It does sound like you've been getting the runaround, though, so this breeder may not be on the up and up. Did you request to see the AKC papers and pedigrees of the parents before you purchased your puppy? This should always be done as part of the screening process when looking for a breeder, along with asking for proof of health testing. If all this is done before, there are no surprises or disappointments afterwards. |
I just went through this type of think with my youngest puppy Coco. She was also from a different state (Its takes me a lot to learn I guess since I made mistakes picking both my yorkies). Anyway, the woman I was dealing with told me she was the breeder and had the female, her best friend had the male. She was sold to me with full rights AKC registration. (I'm not breeding her btw) I got her on 12/1, the papers didn't come.. I tried to contact the "breeder" and she never responded back to me. I filed a dispute with paypal and she actually lied about talking to me on the phone and said that she told me there was a hold up with the papers, she had never given me the micro chip information either. I was able to get the litter number and micro chip number from her through there. When I moved it to a claim paypal closed it right down so I figured I would never see the papers. Well low and behold I got them in the mail today.. shocker! Incidently, i'm pretty sure I was unknowingly dealing with a broker as well since the breeders name on the paperwork is not who I dealt with and is from a different state even. |

It really is buyer beware when looking for a puppy. |
