When she sold me the puppy, she told me he had been given a clean bill of health. The murmur is something he was born with, so had she taken him to the vet, he would have caught it. My vet is going to be calling her previous vet who employes the vet tech and he said he will figure out what went on and will have them fax over any info they have on Capone. I'm going to be calling him as soon as they open to give him the info. I'm sure the Vet wouldn't like to hear tat one of his techs is telling his patients that they don't need a paper that is requires by florida law. |

From what my vet told me, and the other 2 breeders that happened to be there for an appointment, it's required by florida law to get the health certificate to protect both the seller and the buyer from the lemon law. One of the breeders said that a lot of people don't get it, because it costs $100 per puppy, so to cut costs and make a quicker profit, they skip some steps. They also seemed very concerned that Capone got his shots form someone and they said he probably never saw a vet. For now the vet said we're just going to moniter the heart murmur and his actions. Luckily my vet offers a puppy pack for the puppy's first year of life... it includes all of his shots, a year of heatrworm and flea prevention, and also unlimited vet visits. I'm already planning on taking him every other motnth just to the vet can listen to his murmur and then if he thinks it's getting worse, then we'll do a ultrasound. I'm just hoping he has a murmur that will close within 4 months to 1 year. :xfingers: |

I'm not asking for her help for the medical bills, as I know it's unreasonable. His heart murmur may not even cause him trouble for some times now. But I'm more angry at the fact that she did things the cheap way and told me he was healthy when he head a heart condition. I'm not going to pay the full price for something that is broken. If the puppy was a toy, you don't pay full price if it's missing a peace. (this is just an analgy...I am not in any way comparing the dog to a toy. lol.) Thanks for your well wishes & the info. :) |

Sorry, I know this is off-topic, I was just astounded at that price. |

I totally agree with you.....at the very least it seems she should cover the vet visits. He is, after all, guaranteed till the next set of shots I believe you said. This is a sorry guarantee, but on the other hand, most guarantees only cover life-threatening defects, so this might not fall under that anyway....the real point is that she actually was dishonest in telling you he was healthy, and illegal for not getting the health certificate. Since she never had him checked she had no way of knowing. Grrr.....I'm so sorry you are having this experience. We will all be hoping that Capone outgrows that murmur, which remember is not unlikely! :) |

Thanks Anne! Capone needs all the prayers and well wishes that he can get right now! If we can't come to some kind of agreement, then I'll have not choice but to take legal action. She sold me a sick puppy and said that he was healthy...thank god I live in florida, so I'm protected by law. My only option can't be just giving the puppy back. If she works with us and gives us some of our money back, then I won't have to take action and report her to take her to court. My BF is calling her today for me...I worte him a nice long speech to tell her...and we're gonna give her til friday to think about it. I even said that we could take him to her vet if she felt she wanted to get a second opinion on his heart murmur. |
be careful of taking her to small claims court. A friend of mine did that with her corgie and the judge ruled that the breeder pay all the vet bills and refund the money for the puppy then ruled that the puppy be returned to the breeder. I have no clue how the laws are in FL I am sorry you are going through this. I bet Capone will outgrow this :) |

http://www.animallaw.info/statutes/s..._01_29.htm#s29 Claiming not to have the money for his vet bills is no excuse. By law she must reimburse you for up to his full price in vet bills. Florida has excellent puppy lemon laws. Here's an overview: http://www.consumeraffairs.com/pets/lemon_fl.html |

Now this is what I'm talkin' about! I took the part below from the FL Lemon Law: The law provides for replacement plus reimbursement for veterinary expenses related to certifying the illness, up to the price of the dog. If a dog is proven ill or defect, consumers may demand a refund or replacement plus reimbursement of veterinary expenses up to the price of the dog.   |
Does anyone happen to know how I can find info about the FL Lemon Law in spanish? The breeder speaks spanish, so it's easier if someone doesn't have to translate it. Thanks guys! I really do apreciate all of the help and support! UPDATE:: I spoke to the vet this morning and he said that he doesn't think the murmur is a serious one at the moment....he's hoping it will be gone within a month or so. He said we will moniter it again on my next visit..Tuesday 2/26  |

As far as a Spanish translation, I think *every*thing legal in this state is done bilingual. I just don't know where to find it. Perhaps the "home" page offers the choice of English or ???? Both of my pups came with health certificates. Plus, I was given a 1 year warranty on life-threatening defects. The caveat was that I had to take the pup(s) to my vet within 3 business days and report back any issues. Puddin' and Isabella came from different breeders, both from the Brooksville area. |

http://www.doacs.state.fl.us/ai/main/pet_main.shtml There are three options...but I think the two you listed above mean you would return Capone to her. The third option is you sign a waiver to keep him but she reimburses you for the vet expenses you've already paid...but none beyond that. It's a great service for pet buyers, but it is limited to people selling 2 litters a year or 20 dogs. do you know how often she has puppies? Good luck! |
Thanks LadyMom! I wasn't aware google had a translator! I was searching for the publication in spanish. lol. I honestly can't thank you enough for all of this info! |
I imagine this is what your vet thinks your boy has. Since he has chosen to wait and recheck. If he was hearing a more significant murmur you would have been referred to a specialist. Innocent, flow murmurs. These murmurs are caused by normal turbulent blood flowing across heart valves of young dogs. These low-grade murmurs (less than a grade 2) decrease with age as the heart matures and are not associated with congenital heart disease. The vet will do a recheck in 4 weeks to see if he/she can still hear a murmur. Deana Prestigeous Yorkies |
