This is my final post. Sheila & I have not gone back & forth. I received this e-mail from the breeder yesterday evening: "That is your decision but you are breaking the contract by doing so, I have offered to take him back several times,I have offered you his sister or another male puppy out of a different line Shelia and you both know that I would take him back.I talked back and forth to Shelia when he went to the vet at first but you should of sent me all the vet info at that time? Shelia and I were having normal conversations about Max until you ask me to break my contract and I said no. That's when the tone changed. Why are you angry with me?What are you trying to prove? I have broken no rules or contracts.Do you really think I would of let the puppy go with you if I had known?You didn't see anything wrong with him either? I have always agreed to honor my contract ,You knew the contract terms.I am at a loss for what your purpose is?. You also know I told you the picture of the female was labeled wrong ,I admit it. I own Gusto so it was just a mistake in the file, I haven't fixed it yet and I should have but as you know Jim has been very ill and in the hospital 3 times in the month of October,so my mind hasn't been on the dogs,I will be happy to send my contract and all the emails to the BBB and YTCA. I have already spoken with AKC. I think I am the most hurt that you think I don't love my dogs and take care of them If there is anything you could of said to break my heart that would be it .I hope Shelia is feeling better, Judy" I took it in and read it to Sheila and she said she didn't think it was wise to break the contract. So, I replied to the breeder: "In your contract, it states that you do not pay Vet bills, so why would we send you copies? When you offered us Maxwell's sister, I e-mailed you and asked you, if you'd had her eyes checked, had her ears checked for yeast infections, and if you had her checked for Giardia. You never replied. So, no we didn't bother to e-mail you Tuesday after Max's 3rd Vet visit. Now, regarding the picture. I sat here with Sheila on August 26th, when she called you. She told you, "The picture of gustos mom looks so much like our Sydney who we lost two years to the date before we lost our little Kia". You never corrected her and said, "I sent the wrong picture". When we were at your boarding kennel both times, Max was very quiet, and we never really could see his eyes fully open. You're asking us we didn't see anything wrong with him either? We're not Vets. We shouldn't have needed to examine him as a Vet would examine his eyes. You promised us a healthy puppy which you said was the reason for keeping him for so long. You raised him for the 1st 4 months of his life. When our Vet examined him for the very 1st time, she saw that his left eye was very dry, and smaller than his right eye. How did your Vet miss it? The fact that his eye was so dry is the reason she did the 1st Schirmer tear test. I talked with Sheila this morning. I have been keeping the stress from her, because now, due to all the stress, her lymphocytic colitis has progressed to the point, that all she can eat is dry toast, white rice, banana's and applesauce. She can't take any NSAIDS to ease her pain, because of the lymphocytic colitis. Her MS Specialist has had to stop treatment. In yorkietalk you posted that you were never told Maxwell had dry eye, but Sheila e-mailed you the diagnosis on October 1st. That was Maxwell's 1st Vet visit. And you replied that you had never heard of it, and asked if it was like human dry eye. She also e-mailed you this link to health issues in Yorkies. Health Issues I can forward all of the e-mails if you want to read them. She e-mailed you when he was diagnosed with Giardia. She e-mailed you on Oct. 8th, after his 2nd Vet appt. Ok-back to my talk with Sheila this morning. I told her that you had posted in yorkietalk that you would give a Health Certificate on a different puppy from your Vet, if Max was returned. Maxwell's eye condition is going to require life long treatment. You sent me an e-mail and said if we choose to keep Max, we are breaking the contract. How do you figure we're breaking the contract? You don't have "replacement puppy" in your contract. So, here is my offer. Sheila said she is willing to take Maxwell's sister, (She doesn't want a puppy she hasn't met, and she is in no condition to travel. Just going to the Vet on Tuesday was extremely difficult on her, because she is suffering extreme nerve pain in her spine. (She is in bed or on the couch, pretty much 24/7 now.) if you will provide a Health Certificate from your Vet, stating that she does not have dry eye, yeast infections in her ears, and Giardia, and her medical records, and if you will provide her registration papers. And the pedigree of both Sire and Dam, since we have already paid AKC for a 3 generation pedigree. We have Max's registration papers. We would also like a current picture of Maxwell's sister, and her weight. At the Vet on Tuesday, Maxwell weighed 3.15 And he is not over-weight. We would also like a real picture of Treasure. However, you will need to have someone bring Maxwell's sister and the paperwork up here. Sheila is now too sick for me to leave her, for me to make that trip. If you agree, we will not file our complaint with YTCA & AKC, and consider the matter resolved. I will also post on yorkietalk that the matter has been resolved to our satisfaction. And I will ask Administration to delete the entire thread. As for her review in yorkietalk, she posted that review after you sent her friend, Betty, the same picture of gustos mom. They both felt you were being very dishonest. I haven't sent you Max's medical records yet. I would like his medical records from your Vet, 1st. You think we broke your heart? Sheila's heart was shattered when Maxwell was diagnosed. Rich" I mailed the Vet reports to the breeder this morning, and she will receive them on Monday. Rich |
" Don't sign a contract if your uncomfortable with the terms" . This is why breeders have contracts if you don't like the contract go with a different breeder. |

As someone who regularly does reviews based on evidence and/or obvious unethical practices (i.e. per their own websites) I saw the holes in this from the title on....the bandwagon of friends I admired, but I like to see the legitimacy and accuracy of these important claims and this thread really should be deleted. It should not only be closed but completely deleted along with the other threads the OP started about the breeder. The name of the thread is liable. In this age of technology, there is no need to mail the vet records. You or your vet could have emailed all findings. You have never even given the name of your vet so the breeder could contact and find out what is going on with her puppy. If this puppy was truly diagnosed as you have stated, your vet consult with a specialist is not enough. The specialist should have examined Max. You agreed earlier that you were keeping Max and the matter was closed yet and, you are changing things. I too don't understand your motives. |

If I were the breeder, I might be very tempted to seek legal advice. I personally would want my pup back and there would not be another one going there until I knew for a fact the woman could properly care for him/her. I agree that all negative threads should be deleted...but it often is not done...we are given warnings about the fact this stuff is permanent. It angers me whenever I see the topic/subject line of this thread. Much ado if you ask me. I don't even know her but to insinuate that a breeder is horrible because a pup has been diagnosed with dry eye?? I am baffled. |

For anyone reading this who is looking for a Yorkie from this breeder. I, who regularly review Yorkie breeders would highly recommend this breeder who has over 30 years experience and only this one complaint on that end the breeder did try to fulfill her end of the contract that was signed and agreed to buy the original poster. Whenever you purchase a Yorkie from a breeder be sure to have a lawyer go over the contract and then decide if it is one that you can adhere to. A contract is a contract that once signed is a legal document. If you are not happy with the contract presented to you discuss with the breeder before signature, if an agreement can't be made do NOT sign and find another breeder. |
