Oh Gosh I hope you can keep the puppy, I certainly hate for her take him back and he is already sick. So sad for these little guys. After I got Jack my 1st, I was not aware of puppy mills. Did some research later and oh boy the stuff I found on the internet of my breeder. Wasn't good. I live in Florida purchase him in my town, found out my Jack come from Oklahoma. :eek: |
help Well, bad news. I talked to the animal rescue and they ere told by police if she shows up at my house with officer, I have to give puppy back! But I have all the documents to show police about her. Hope its enough to stop her! |

i shouldn't have to pay under false pretense. I would have just taken her to court for what she did. Under puppy lemon law, I don't have to give her back because of my vet cost. She needs to pay Mr for that 150%!!! |

Unfortunately, Chinalee, the way you went about the situation is of itself illegal. As it stands now, the puppy is still legally the breeder's. Puppy lemon laws are enforced via the court system if the breeder isn't amicable to rectifying the situation prior to legal action being taken. As far as your expenses you've spent on the puppy at this point...you will have to sue her in court to recoup those. |
In CA, the puppy is considered property if payment was canceled in whole then the property is in dispute and it can be taken by police and returned if she reports it (the pup as now stolen) however it can also be considered that you own the puppy but have failed to properly complete payment, and she can simply sue you now for your having canceled the check. You really need to just send her a check to ensure your pup is actually yours (however it can get nasty and she could refuse payment) so ensure you send it certified mail. Then you need to file in small claims over this-you can't issu and apply the law yourself and note your own verdict-you have to fully comply with the laws and accept whatever ruling a judge decides. It would be very worth it to find an attorney who does free consultations and will use that time to advice you on the proper course of action, then tells you at this point your do A, B and C then if D becomes and issue you retain me and we will do the next A, B and C. I hope it all works out in the best interest of the dogs involved. |

According to puppy lemon law she is to provide ALL PAPERS at time of purchase. Which is akc/DNA, and health certificate from her vet. I received nothing! Until she gives those documents, she will be paid the rest of her money. From what I've heard on this site, other people have waited years and have not received any papers as promised to them. I've also met others with the same problem. I'm not the only one there she has scammed! |
Slowly, you have not paid for the puppy. Now you can be charged with theft. You have an something you have not paid for. It's unfortunate she sells pups with no documentation, it's sad they are ill. All of this should be rectify....but the court decides. You mishandled it. The pup will be returned to her by legal authorities. You will have to sue her for whatever amount in cash you presented. |
