Guarantees It came to my attention on another thread about guarantee loop holes, giving the breeder a way out of guranteeing their puppies. I thought it was a great subject and should be discussed. Guarantees have always been one of my pet peeves.. IMO Most guarantees only protect the Breeder, and why oh why would someone who already paid shipping for a puppy have to pay shipping to return a sick puppy and again pay shipping for a replacement? Paying shipping the 1st time for a healthy puppy should not be punished if they received a sick puppy. I feel it is the Breeder's responsibility to take the loss and pay the shipping. And IMO the owner should have the right to keep the sick puppy if desired and receive a replacement or refund, since they are already attached and wouldn't want to give up the puppy. I'm always trying to improve my guarantee to protect the new owner, and the puppy and yet not get taken advantage of either, since that does happen too. I am always willing to accept suggestions to further improve. SILLERS FARMS (The guarantee is on last page) |
From one Deb to another...you're my new hero. I have never liked the replacement puppy guarantee vs a refund for vet expenses up to price of puppy. |
You are right and I will be changing mine as soon as I can get my scattered brain together enough to write a new one. I need to redo a lot in my contract because I have learned a lot since I first wrote it. Deb, if you want to pm me and give me some idea of how to write it, I would appreciate it. Thanks |
Wow, Your health Guarantee is just lovely! |
Thanks!! And Dee, feel free to use anything off of mine, if it helps. I haven't had a chance to look at yours, but I'll help in any way I can. I've bought puppies myself and been screwed so many times that I guarantee the way I wished I'd been guaranteed! |
Dittos on a very good guarantee. I suggest having the buyer sign it too. Even if the pup is shipped to the buyer, you can have them mail the signed guarantee back to you. Bill |
Thanks Deb for posting this. I have had a no "loop hole" warranty for the last 3 years and have "by the Grace of God" not had anyone have to use it as of yet. As I said on the other thread I don't breed very much. When you are writing your contracts there are some things that must be present in order for it to be legal. You must have responisibilities laid out for both parties. It is not a contract if it is one-sided. It must be dated and include what they are purchasing, the amount received for the puppy and if you are one that allows payments, the payment arrangements, and the length of the warranty. Mine is 3 years like yours, but I would honor it for longer as long as I am still breeding. I limited it due to my Lupus and a fear to project any further in my breeding, but I think that if a dog I placed was dx at an older age with Liver Shunt or something on those lines I would still replace the puppy if I'm breeding then, if not I would still work out an alternative with them, like help them get a new one and me pay on the pup up to the amount that I received or something on those lines. I hope it never happens! but it could. I think that the more that we can teach each other the better breeders we can be and the happier our dogs will be. I hope the days of the "loop-hole" contracts are numbered, but you will always have some out there that give no warranty at all. |
In my contract I give the choice of a new puppy or a full refund. I don't ship, but if I did I would not make the customer pay to ship again, kinda crazy in my books. |
Hey Sonja! I used to have the price on my guarantee, but so many wives asked me not to put the price ~ in case their hubby seen it :yelrotflm That I just finally left it off. I thought leaving the price blank looked worse to husbands than not there at all. I alway tell them I understood, I have a husband too ;) |

Deb you are my hero also... a good breeder that does not jump in to judge people but has patience to help anyone.. I would so love to follow in your footsteps if I continue breeding.. for I have seen no one any better then you... I thank you for posting this.. kathy (6yorkies) looked at your guarantee and loved it way back.. I told her to go and look at yours.. and your so right.. if a puppy gets sick and has a guarantee a person should not have to give up a dog they love if they are willing to care for him/her and keep them.. and yes getting a new puppy in place.. Deb I like the way you think....and i totally agree with you |
I really wasn't trying to blow my own horn. I really wanted to point out that not all guarantees protect only the breeder. For years I have been just shaking my head when I see some so called guarantees. Thanks Sonja for bringing that up in another thread. And give Taz and Rowdy a big kiss for me! |
Wow, I'm so glad I opened this thread. Amazing Yorkies, I commend you for being so honorable. |

Deb I do not think any one looked at it like you were as you say blowing your own horn.. but my having yorkies now for 20 years, I have seen a lot of guarantee, and have had them not fullfilled and have lost many a dollar over this.. so to me as I am sure others it is a very good topic to be brought up.. we as people need to know who we can trust...is what I feel.. anne |

I couldn't agree more. I feel that if you are breeding, then you better stand by what you've done. If you can't or won't, then you shouldn't be breeding! |

i agree! |
Good thread. I will give a buyer another puppy or pay for medical care up to the purchase price of the puppy. I do not require the buyer to return the puppy to me, but I will take it back if they request me too. I stand by my word. |

I just read your guarantee, is it typical for breeders to guarantee liver shunts and things like that up to 3 years? I think our breeder is giving us just a one year guarantee. I understand 3 years is obviously better, but is that typical? |
I think 1 year is common. |
