Everyone aAbout Breeding: Studding If you purchased (adopted) an older male from a breeder. Between the time you paid them , signed contracts, and were the owner of the dog however had not gotten the dog: 1 is the breeders right to, 2 doesn't matter, 3 or very wrong, the breeder studded and bred the male you bought? |
I'm not sure I understand? Why would someone purchase a dog and not take possession? And wouldn't this be covered in a contract? |
Oh my so complicated I know right. Why wouldn't this be covered in a contract-well this situation is probably very rare-it's just a random poll to generate thoughts on the subject by people here for my own curious mind. Well some of us made the mistake of buying a dog from across the country and having it flown to us-live and learn, warn others. The real example is the dog was fully paid for, the contracts in place the breeder should have sent the dog but something came up and in the mean time after the completion of sale payment and after dog should have been sent the breeder bred the dog to several bitches. |

In Canada, the date of sale on the contract is considered to be the date the buyer owns the dog. Therefore if the dog is used at stud it would get pretty complicated as technically the breeder does not own him any longer. For registering resulting litters, I would think the new owner would sign as owner of stud. Gotta watch who you are dealing with. the breeder should have had it in the contract that he/she can use the stud dog for breeding purposes until the new owner takes actual physical possession. |
So this was not accidental and the old owner purposely did not get permission from the new owner? I think if they wanted to breed him one last time or something, it should have been discussed ahead of time. Yes... live and learn I guess. |
Okay yes this is an issue that did happen, yes to me, no I was not told until months later but... But I'm just asking a general question about people's opinions in this general situation. |
YOUR name has to go on the registration papers for the litter, as YOU were the owner of the stud at time of breeding. YOU also should have been paid any stud fees for the breedings that took place. |

No the dog's AKC papers never arrived and that became a different dispute in this situation. The wording was pet only which was verbally explained as limited registration and later when I contested no arrival of the transfer papers etc it was stated pet only no papers-the contract was unspecified as only pet or for breeding with no specification of limited or full AKC registration-ridiculous! |
Why was the dog not fixed prior to purchase? Where you thinking about breeding/studding him yourself? |
