can you apply for a new credit card and use it to pay off Maddie. I know it wont clear everything up, but at least you will be able to keep her. So sorry you have to go through this.

Ok i would meet the sheriff in person at the office and ask for ID Could be someone claiming to be a sheriff. Also before you do anything you need to make sure they cannot put the transaction through after you pay it again. This does not sound right at all. Why would they wait 2 months to start complaining about this? I would not only keep your account frozen but have your cc co change your acct # . I personally think this is what's going on.... I think they didn't run the cc transaction through yet and are making a big fuss so you will find another way to pay for Maddie and then after you pay again they will send the first transaction through so they will be paid twice this is the only thing i can think of. Please be careful. You do owe them the money for her but i can't understand how they ran your check but there is no record of it with your cc co.

I remember when you were going to pick her up and the breeder was MIA and not returning phone calls at all - until you showed up. Hang-ups when you answer really don't count since you don't know this is her. It could be her calling and hanging up so she can show phone records of attempted calls. The records would also show the duration of the call, however.

Are you positive that nothing has been charged to your credit card account from the original check? I'm still wracking my brain trying to figure something out for you.......

Amber, I understand what you are saying but since the account is now frozen and the cc company has flagged the check, they can't run it now. So I have to take them the money. The cc company already mentioned changing our acct # because they said because of the way she ran the check the acct # is now out there in cyberspace?? I don't understand that one either, but basically the lady just made it easier for someone to put charges on the card.
So now I gotta go thru the cc statement and make sure every transaction is on there is ours.

Did the sherriff tell you that criminal charges where pending agaisnt you ,or you husband?He signed the check right?
WHY WOULD IT BE YOU? Have you called and explained all this to the breeder,confronted her on you not recieving any calls?

And thanks to a very special person, I can go pay for Maddie. But we are going over there with the sheriff and I am getting copies of EVERYTHING and making copies to send to the cc company.

The sheriff said if I didn't make a decision to either pay or return the dog by Wednesday then they would be issuing criminal charges against me. ME because I am the one who signed the cc receipt that printed off the register and I am the one who took the check over. Yes, my husbands' signature is on the check.

I am still having this investigated. I don't understand why the transaction was on Nov 19 and it wasn't until Dec 21 before it was NSF? The CC company said it should have been done in 5-7 days from the date of the transaction.

Another thing, when they process a check like that and it goes thru with receipt and everything, they have the money right away, its processed like a debit card.
Unless, the clerk made a mistake and it got deducted from someone elses account, they noticed it did a charge back and voila two months later they want their money.
Something stinks.

Honey, there is no way in heck he can have a copy of your check because you have the original check, it was never sent anywhere. Are you sure he's really a Sheriff? You need to go to the Sheriff's office and meet with him. He would have contacted you in person.

I don't think Sheriff's give ultimatums like that. Can you contact the prosecutor's office? I work for a criminal attorney and where I'm from the police file the report and/or arrest you for a crime. The case is forwarded to the prosecutor's office and it's their decision to charge you or not.

You need to talk to an attorney and ask if this is on the up and up. Have him call the Sheriff. I'm telling you something stinks in all of this.

I called my local sheriff here (different from the sheriff who called me) and he said he understands why I was upset and if it was him he wouldn't want to give his dog up either...not for a million dollars...and he also said since I was wanting to resolve this he didn't understand why the other deputy was mentioning the criminal charges at all. He said if he was the deputy handling it he wouldn't do the criminal charges since it was something I was willing to resolve and he agreed that I should be allowed to keep my dog. He advised me to just let the other deputy know right away that I wanted to resolve the issue as quickly as possible.

So that is why I did. I called and asked the deputy if I could have a couple of days to figure out what I could do and he said he was off until Wednesday at 7 am and that is why he gave me until Wednesday. He said worse case scenario I lose my dog. And I started crying and said I loved my dog and that I didn't want to lose her or go to jail and he kind of chuckled and said he didn't think I would see the inside of a jail cell. But then he said he didn't really want to send the case through and have criminal charges against me, but that he would have to if I didn't resolve it. And he claims the NSF is straight from the Bank and that it is the Bank that sent it to him, not the storeowner, but he has already talked to the store owner and he mentioned both the store owner and the breeder by first names in a familiar tone like he knows them both personally.

Like others are saying, be cautious! This sounds very fishy. I worked in banking (some of the years in the ACH/Check clearing Dept) for almost 10 years, and I've never heard of a situation like that!

If the bank sent it then the bank paid on it, right? I would think so. The bank doesn't take any sctions unless they are out the money. I think your breeder got paid and that is why they haven't contacted you.

One of my best girlfriends is a commander on the Sheriff's dept, I called her really quick and she said they usually don't get involved in cases like this.
She said the bank does not send them that kind of information. She said to go through your local sheriffs office and start a file there with all your documentation.
She then said to go with your husband or friend to see the sheriff who has been calling you and get copies of all his documentation. She said she would recommend going to the store and talking to them in person also and get copies of what they have.Do this with the breeder also. She said she has never heard of a straight transaction being treated as this one has been handled. She also thinks something is fishy...make sure you have your credit card company change credit card info and follow this through...something is not right...I feel your being set up for a scam of some sort!

Is it possible that when the check was taken from you the friend's pet store to be "verified" that a copy was made or at least all the information taken on the check taken down? With that infor, a new check could be made and used. That's the only way the sheriff could have a "copy" of the NSF check. Something is very wrong and I think you should dig out your bank statements and credit card statements that you have since the purchase of Maddie. Go over them very carefully. Can you call the # on your CC to get a recording of all purchases? You need to investigate this thoroughly from every possible angle. Try to put yourself in a thief's shoes (I know it's hard if you don't have a mind for that kind of thing), but it's pretty easy to get away with stealing from someone if they aren't on top of things. I don't know how old you are, but if you are young, you are instantly prey for the criminals and identity thiefs. And if you get a group involved, like it seems you have, then you are going to need help. Do you have legal aid available to you? Check with your courthouse or welfare system. I hope who ever is responsible for causing you and your family all this torment gets what is coming to them. And thank you "Special Angel" for helping sweet little Maddie stay right where she belongs.

Sweetie, this sounds like an out and out scam to me. Are you 100% positive that you spoke with a REAL sherrif/cop? It could have been a friend of theirs. This whole thing smells to high heaven, and I'd certainly get someone else involved. You have a RECEIPT! OMG I am so sorry for you, I hope that this can all be worked out without you having to return the dog:cry:

The more I read, the more this just SMELLS. Get a third party involved. FBI, anybody. By the way, sherrifs don't call you on the phone about stuff like this, they serve you with a notice, in person, with so many days to clear up the matter (usually 10 days). Sounds like someone is trying to get paid twice, or re-sell your baby:( :mad:
