Jeff Dane emails I know some of you have received emails from Jeff Dane, but I have received none. I guess he does not have my email address and I would rather him not have it, so I will post this here....I have yet to be served papers on this so called lawsuit, however I have decided to go ahead and retain council. Jeff Dane will be receiving a certified letter from my lawfirm early next week. Once his council sees who is representing me I am sure all of this will be dropped. I want him to know this is not a personal attack. I just feel as if I have been treated unfairly by him. I DO NOT like the fact that I am at the "top of his list". Nor do I like him trying to scare us with these emails. Like I said, I have yet to hear anything about this lawsuit personally, but believe me I am well prepared. He really doesn't know who I am, or none of this would be happening. Thats all I have to say. |

If I had a buck for every one who has threatened to sue me, I'd be rich. Lawyers will only sue, if the know they can win, and if the know the person has enough assets to sue for. They don't like to loose. And big guys sueing little guys is rarely profitable. |

Wick Phillips LLP Ok guys I just got off the phone with my attorney, Wick Phillips LLP. (go google search that jeff dane!) They mostly handle fortune 500 companies, but since I have the hookup....they are helping me! :) According to my attorney, Jeff Dane does not have much of a case against me, or any of us for that matter. The burden of proof is on him, and I think he would rather not get himself into that situation! Everything I said in my post is true to the best of my memory. I refuse to back down. My attorney did say however I do have a good case against him. He misrepresented the dog he sold me. I could sue him, but I am going to wait and see how far he goes with this. Like I said before, I have yet to be served any papers, and I believe the best lawsuit is no lawsuit. So...come and get me! I am ready! Whatever happens, you can't unring a bell. My thread has already been viewed over 4,000 times. If I can help one person, I feel accomplished. |

Forum Lawsuits I just saw this on another website today. I thought I would pass it on. "The California Supreme Court ruled Monday that bloggers and participants in Internet bulletin board groups cannot be sued for posting defamatory statements made by others. In deciding a case closely watched by free speech groups, the court said a federal law gives immunity from libel suits not only to Internet service providers, like AOL, but also to bloggers and other users of their services." http://www.msnbc.msn.com/id/15817955/ It seems like the key word is "by others" - the ruling doesn't give an individual the right to defame someone, but it appears to extend ISP protection to bloggers, forum operators, etc. It will be interesting to see what in-depth analysis of the decision reveals.
