yes it is. And I never said anything about the size being a issue with the male I have. Termination is you saying you want lola back. And I never offered $3000, I have always stuck to a price & that is when I thought you had a healthy yorkie. I have defended you many times in this thread saying you are not a breeder, that lola was your pet and I have said we are on myspace & have talked over a year about lola. But you were dishonest about alot of things about lola.

And another thing Maria I have not crossed you I simply came hear for opinions, I am sure I have told you about yorkietalk many times, I tell all yorkie owners about it.

You also haven't shared why we decided we want her back. My six year old son was at my parent's home on fall break when I decided to let Lola go with Rachel. Since Lola is primarily my dog, and my son has a Golden Retriever, I didn't think he would be too upset. I was wrong. He's asked me every night when Lola's coming home (I told him she may or may not be coming back, that she's on vacation with other Yorkies), and when I asked him what he wanted for Christmas, he said that he wants Lola to come back! And now that I'm not working, I will have plenty of time with her.

That's another HUGE thing you've left out.....why I'm not working! I could pay you right now, but I'd rather not. I'm sorry, but with three trips to the ER at $150 a piece, five doctor visits with my co-pay being $30, and numerous prescriptions in the past month, finances are a bit tight. I've told you the minute I receive my monthly check, the money is yours. You complain about having to care for her, at your expense, until I get her back. I am the one who drove an hour and a half each way, from Indianapolis to Cincinnati, to take her to you, I think that just about covers the cost of feeding her for a few weeks.

I sent you a very nice email, saying that we all miss Lola, and asking how you felt about her coming back to us, I was very considerate of your feelings. You called me the next day, talking about her health problems, and said you didn't mind at all her coming back to us! Then the next day, you call me again, talking about having me write you a statement saying that I void the contract. The first time you called, you were trying to get me to take money off the dog, the second time you called, you were trying to trick me into writing something to could leverage you to be able to keep the dog. I'm a little more intelligent than you honey.

The contract says if at any point Rachel determines that Lola is not adjusting, she will return Lola. All money paid to Maria will be repaid to Rachel within three weeks from the date of termination. That's the only thing it says about three weeks. It also states, if at any point before January 1st, 2008 Maria wants to terminate this contract she will pay Rachel her full deposit at time of termination. Termination babe, is when we exchange Lola and the money. As for the microchipping suggestion, I've printed every page of this thread, so that option is out. If you looked closely at my MySpace page, maybe you noticed that one of my very best friends is an attorney. One of the benefits of that is, of course, free legal help. But truly, I promise you money is of no issue. I would bet my child support alone is more than you earn.

You made some inane remark about me slinging my dog around in her carrier. I told you, I put her in there twice, she got sick, so I never put her in again. You're the one with the lovely fake Vuitton carrier, carting your poor dog around everywhere. A dog is not a status symbol to me. At work, we make fun of girls who cart their doggies around. Soooo cheesy, and such wannabes. A dog doesn't buy you class Rachel. It's just about as classy as your fake bags. You're so 'hood rich' it hurts.

The only reason you want Lola is because of how small and pretty she is. My mom bought Lola for me, for Christmas, and I could care less about her size or her breed really. I bet you haven't told the people on here the reason you are not keeping your male puppy. When I asked you if you were keeping him, you said I don't know, I don't know how big he's going to get. Nice.

Go ahead and spay Lola. I know nothing about breeding, I don't want another dog, and I don't need the money. Hey Genius, when I told you the vet said she was clear to breed, did you ever think maybe I was trying to see what your reaction was?? And no, we will not be selling her. I love my dog, my family loves my dog, and now that I'll be home to work with her, she's definitely not going anywhere. And now that I've seen what type of person you are, I realize I made a huge mistake.

I always stand up for what is right, and I'm not going to allow you to lie about me. You will return my dog, and I will return your money. End of story. I think you know by now to not cross me anymore than you have.;)

And you have had this wonderful dog that your mother bought you for sale for a year why???? Rachel is a VERY caring person...Lola couldnt be in a better spot!! Can you not see her love for Lola??? I dont understand why you sold her to begin with?? Is this not something you discussed with your family in the whole year she was up for sale??

Rachel no matter what happens I am here for you 110% do not let this womans THREATS worry you a bit..we ALSO have some terrific lawyers here on YT!!!

Rachel, it looks like your in deep at this point, this is all going to boil down to that contract you have....your interpretating things one way and she's interpritating things another....

It looks like she's not going through with this deal, you may be going to court in order to keep Lola...it may also require you hiring an attorney or you may be able to file a claim in small claims court....I hope things work out for you but it may get real ugly for all involved in the coming months....Good luck

I can say, as the person who posted the link to the myspace page that this poor dog was listed off and on for OVER a year on different websites and also on Myspace.

The price would change daily and sometimes a couple times a day. So would the weight(2.4 pounds somedays, other times 2 pounds, now I see it's 3) I feel sooo bad for Lola. The original owner obviously thinks of her as a possession, not a companion. I would not believe a word posted by her and I seriously doubt anyone really does believe her. This dog was for sale for a very very long time, please remember that.

I don't know if I feel worse for Lola who deserves a loving home where she is wanted or Rachel, who only wanted Lola to love and take care of and is now being put through the ringer. It sounds like Lola needs some medical care that Maria was not giving her and can NOT afford.

jp4m2, I agree.

Maria, I must say one thing Rachel came here for our opinions and we gave them. It took forever for her to even see that there could be the slightest problem here so you can't fault her there. I think you could be more understanding and come out way ahead. JMO Why not take the high road and we'll admire you for it.

I'd like to know exactly what I've been dishonest about?? Her health? I've never stated anything about her health. On PuppyFind, I listed that a vet examination would come with her, but that was it. And you didn't go through PuppyFind, nor did you ask me about taking her to a vet.

And you state that her color, size, and age are different, that the pictures are a year old. You know exactly how old the pictures are! Her coloring is not at all different, maybe it's due to it being a picture, and the lighting! And sorry if she weighs a few more OUNCES than she did when I listed her last year. I am honest, clearly to a fault as I've been shown here, and I would have been more than happy to have you, or anyone who was interested in her, come meet her first. You asked me if she could come to your house, see how it works out....you yourself called it a trial period, you have the opportunity to back out if you are unhappy with her.

And sorry, but I have ALL of your old emails, and you did offer me $3000 the first time you contacted me, but I had to come meet you with her the very next day, which is why it never happened. And you absolutely did say the reason you may sell the male puppy was because you didn't know how big he was going to get!!!

Also, Lola and Tilula fighting is just another reason for Lola to come home. She gets along perfectly with our Golden, and has been around many other dogs in the past with no problems. I don't know what's going on, but obviously it's not working out with them.

I don't want to post here again, I don't enjoy arguing with you in a public forum. But I'm not going to sit back and let you lie either. Rachel knows exactly what is true and what's not, she knows who's been trying to scam whom, and that is on her conscience, if she has one.

I usually don't post on this kind of stuff, but I've been following the thread from day 1 and also saw her ad on puppyfind (I had been looking for a new addition since January).

I'm in Business Law right now (we're learning about contracts) and in order for a contract to be legit there has to clear terms.. The whole "time frame" is not clear.. So they may end up throwing that part out.. It all boils down to: she sold Lola to you, therefore she is yours..

That would be like my breeder selling my two girls to me (3 weeks ago) and then calling me back today saying she wanted them back.. Get out of here..

Rachel, stick to your guns and fight for her. My mother went through the same thing when she bought her Golden Retriever.. Owner wanted her back, kids missed her dearly, blah blah blah.. Long story short: My mom kept her..

If you'd like me to quote anything out of my Business Law book, let me know. And it is up to date.. We wouldn't learning about it in college if it wasn't correct.. :D

My two fought with my boyfriend's sister's yorkie/chihuahua.. Did that mean I was giving them back? Hell no.... You sold her and tied her to a door while you were gone at that! I think its in Lola's best interest to stay with Rachel..

Wow Maria you really are quite an angry juvenile person aren't you. Coming on here to stick up for your self and throwing names at people you don't even know is not going to make you believable.. this is laughable.

Every person who I have even known to throw around how they have more money, higher status as far as class goes or whatever BS they think people will somehow rank them by is just talking out of the azz anyway. So, there you go as far as how you have proven your credibility Maria. The truth is you don't have a leg to stand on. You don't even deserve to have a pet, they are a life long commitment and when you get one you don't sell it off for ANY reason.

I do have lolas best interest in mind. I am sorry you feel betrayed. I wasnt trying to make you out to be a monster. You are just to busy for lola & not aware that yorkies have health issues & need to have a check up now & then. I would have had her checked before thinking about selling her. The only reason I would have said anything about my boys size is if you asked how big he was going to be & I answered I didnt know, although I dont recall us talking about him at all. And when you say a vet has okd her for breeding, you are saying she is healthy because vets do not ok dogs with genetic defects for breeding. You've also listed her as akc, but never can produce papers. You know I may have said once because you were mentioning selling her to a breeder that I would try to come up with your price because I thought I had it on my credit card but then had to email back & say I didnt have it & just couldnt put my family in that position & begged you not to sell her to a breeder many ,many times. Thats why when you once again wanted to sell her you right off that bat said she is breedable because you know how i feel about her & that kills me. I am willing to pay the $750-$1000 for her knee surgery & anything else she needs. I am happy for you if your child support is more than my pay check is. What it comes down to is that I dont care if her age & color are different and she has no papers, although I did ask you those questions & for updated pics many times. I just thought you could be more fair. I want to give her the best life.
