Desperate--Please Help Me A while ago I posted about our experiences with a broker/pet store owner in Redlands, CA. Now she is sueing us for saying she sold us a sick puppy and wasn't honest about pedigree etc. in small claims court. I really need your help. There is lots of second hand information out there about this woman and her pet store; I need anyone who has had any experience with her, to please contact me at either my website or by a PM here. We are always talking about ethical breeders, sellers, puppy mills. She sells puppies all over CA, Arizona, Nevada etc. Some one on this board knows I am telling the truth and I hope I can get the first-hand knowledge to win against her in court. Please help. |

Good luck sweetheart. Please try NOT to panic, stay calm....... In the first place, unless there is written communication, it will be very hard for her to prove anything. And if the puppy was sick, get documentation from your vet to help build a case. Maybe taking the approach that -- "yes I said those things and they are true" might work. Law suits are very scary, sending hugs :ghug: and I will carry you close to my heart. When is your day in court? |
Have you contacted a lawyer? Did you visit the place where she has the puppies? If so, how were the conditions there? If the conditions were poor, I would try to get someone you know to go there for you pretending to be interested in a puppy and try to take pictures...if that's even possible. Also, get a copy of the puppy's vet records and ask the vet to write a statement about the condition of the puppy when you bought it. Other than that, I don't know, but good luck! |
try looking for info about her ob the better business beauro online www.bbb.com and try www.ripoffreport.com. Try googling her name along with the phrase sick puppies, and see wht comes up. This helped me tremendously with a bad breeder/broker who sold me a dog with parvo who died a few days after we got him. When I researched her name I was shocked at the amount of complaints against her and I found someone who had been through the same thing and we communicated and compared horror stories. If where you got the puppy, the conditions arent very clean or something, have a friend act like they are interested in one of her puppies and have them take pictures. She cant prove what you said, plus if you have proof from your vet that the puppy was sick then I would say she doesnt even have a case. Maybe she is just trying to scare you for some reason. Do you still owe on the puppy? |

Scrapindee...She really can't sue you and win - you shared a personal experience online - that is NOT Slander.... when I posted about Brushy Creek Kennels I heard the same thing from them - but they couldn't do anything about it because I stated MY experience. It did blossom into a big thread - but it brought together people who saw it and had sick puppies sold to them - So...it actually did alot of good. I did talk to someone and was told because I shared MY experience and was truthful - there was nothing they could do to me. |
We have this thing in America called freedom of speech (First Amendment to the Constitution). Usually, statements of opinion are not actionable in tort because they are protected under this amendment. The only way they could sue you is if you made false, defamatory statements that wrongully hurt their good reputation. As long as you told the truth, you do not have a problem. Hope this calms your nerves. |

Well it really doesn't matter what others have to say about her in this case. If she didn't sell you a sick puppy and you went around telling people she did you may be held responsible for damaging her reputation. If you had the dog for a few days and have vet bills to prove you it was sick within those few days you are fine. If you had the dog for a few months on the other hand and it became sick that's a different story. If you went around saying that she's lying about the pedigree of her dogs and have no proof of what you are talking about then you may be held lible. Sick and lying about pedigree rumors could and should close most breeders down so I really hope what you said about her was true. |
We will be countersuing for selling us a sick dog and two misleading us about the dog's pedigree. I will keep you all posted as to what eventually happens. Today we are going to go to the local courthouse and see how many other cases have been filed against her. |

Liable or defamation of character can only be won in a court if the statements are untrue. Have documentation to support any statements she has proof that you said. I would also countersue for any vet bills you had and any pedigree issues - documentation is the key, vet bills, articles or vet letter stating the incubation period of the illnesses your puppy had. |
We've got all that or more. PIA that we will now have to pay for an attorney rather than do this in small claims court. She is going around and telling people this might cost her, her store. Wonder if she is prophetic???? |

lol I watch too much daytime court tv, but they can sue you till the cows come home and they'll still loose. You can say what you want as long as its true. Wonder if you can counter sue them for malicious prosecution.(I think thats what its called.) Just make sure you have notarized statements from those that know you got a sick dog from them as well as documents that state that you were wronged by them. You said you said things about them on here, right? Maybe you could print those as well... |

I definetly think she is just trying to bully you. I had a HUGE designer company (you guys would absolutely crap if you knew who) threatening to sue me and continually sending me threatening letters and it was all just a tactic to scare me. Definetly Fight back!! :thumbup: :thumbup: I dont see how this breeder can possibly have a case, but it sounds like she is defiently not a good person. |
I did try to do a search for you, but all I came up with was the complaint by your husband, as you know. I didn't find anything where someone else had made any complaints, but that doesn't mean that none have been filed. As long as you go to court with documentation from your vet stating how sick the puppy was when you got her, you really don't have to worry. Just make sure you take all records from the vet with you and make sure everything is dated. It might also help if your vet can write a letter for you summarizing the condition the puppy was in when you received it. Good luck, and please let us know what happens! |

We're certainly going to fight the good fight. Waiting to hear from our insurance company. We have found a good attorney but we need to wait on the insurance company to make a decision. |
