As is????? Have you ever heard of someone not giving a gaurntee on a dog. This lady that was going to mentor me now wants an as is policy on the dog. I know he is free and all, but this worries me, what happens if he gets sick and dies, would I still owe a puppy? Sorry she just called and asked , I am wondering if I should still go through with it please help, I was suposed to pick him up tomorrow |
You definitly want to clarify that with her. Sometype of gaurantee is expected with breeders. I would be questioning why not now? It is hard to say her reasons though. It does sound fishy. Even with a guarantee it is hard to imagine that your pup can get sick. Good Luck |

Sorry I have to ask.......... If the pup is free, other than taking the pup back or not expecting you to breed what else should there be? Breeders should refund the price of pups that are ill, but those are bought pups. If there's no contract she can't make you give back a pup from it. If there is a contract there should be a return clause and reasons of health the pup should be spayed/neutered. Is that what your looking for? |
No the deall is that in return for this male dog, I will return one future female puppy to her. That is why I am worried, if something goes wrong and he dies or something then I want to know what I am obligated to |
Then she has to give you a contract to enforce the future pup back. If the male is neutered and you don't have a contract its not really enforceable. If she does want it in writing about a future pup, just ask her to add its contingent on the male being sound enough for breeding. If she can't do that, I would walk away. |
It doesn't matter —pet quality OR show quality— I wouldn't touch a breeder who wouldn't give a health guarantee at least for the first year. That seems really shady if you ask me. |
Excellent question, Marlee. I've never seen this addressed on this forum. Of course, if the puppy dies, then you will have no litters from him so your obligation would be null. I think I'd want a contract on this. What do breeders on this forum think?? |
I don't know any breeders who give more than the purchase price of a pup back in their guarentee. At least not in writing, they may help with vet bills above what the contract says. If there is no money being exchanged there is no consiquinces for the guarentee, thus its usless to the new owner anyway. See what I mean? The pup back is another story. Its future payment and for the breeder to collect she needs it in writing. Thats where health and breed ability should come into play contract wise. |
Marlee, why don't you go see the puppy and see if he looks sound. I'm such a softie I'd want to get him away from her! If she wants a contract for a future puppy, then tell her she should be confident enough to guarantee his health in writing! Stand your ground honey! she sounds like a flake at bet and a crook at worst to me! The puppy would be better off with you Im sure! Just my HO. |

Would you really give him back to her if he were sick? I don't think I could! As for mentors, aren't there lots on YT? You are in a Catch-22 I think! Let us know what you decide to do! Just don't let her run all over you! |

Okay, here is a good analogy, I hope. What if soneone were "giving you a car for free"? Would you expect a warranty? I know this is a puppy and not a car and we get emotionally attached to a puppy, but I don't think you can expect her to give you a puppy with a health guaratee which would obligate her to replace the puppy if it had something seriously wrong with it or died when you are not paying her for it. I think you are lucky to be getting the puppy for free, or in exchange for a future pick of the litter! I would put it all down in writing in a simple format to cover as many contingencies and possiblies as you can come up with. Just state that if the puppy dies or is not suitable for breeding for any reason, you are no longer obligated to give her a puppy from a litter. She may want something else in that case, like a small amount of money for the pet she provided you. A contract or agreement to be legal requires that both parties get what they bargained for. Just like it wouldn't be fair to hold you to giving her a puppy from a future litter if the puppy ends up unbreedable, it also wouldn't be fair for her to receive no compensation at all for the training, advice, mentoring and free dog. It must be an agreement fair to all parties. |

This is a breeding dog? As is?? So you will be making more puppies with an "as is dog"? This is extreamly odd? Free or no free, this is too weird. Id walk away. What does the future hold for Yorkie pups with an "as is Yorkie stud"???? :confused: |
free I may have miss this point...do you have to breed this male to your female and give her a pup from this breeding? If so, think long and hard...it is very, very hard for a pet lover to give up a pup to a breeder..you will have no say where it goes, she could promise to sell it to a pet homr, only to sell to a high volume breeder..I am a breeder and I don't let pups go to these places..in fact I perfer mine to be pets period! |
Good point Pat! You could put that in the contract also. Spell our everything you want to happen in the agreement and everything she has promised and you have promised so everyone understands the bargain and the entire arrangement. If you don't mind giving her the puppy from the furure litter under certain conditions, spell them out. "AS IS" just means you are accepting him "as he is" with no guarantees. He is still registered and has papers, etc. so he is still okay for breeding as far as all of that goes. The breeder who is giving the puppy away for free is simply alleviating herself from any liability should the puppy become ill or if it is discovered later that he has some defect or whatever. She just wants Marlee to know that she is not responsible for replacing him if any of these circumstances occur. I think it's a win win for Marlee. She is willing to give you a show Potential puppy, mentor you and teach you how to show and breed, all in exchange for a puppy from a later litter. She sounds pretty decent to me, but then I am trusting to a fault sometimes. I always try to see the good in people over the bad. |

I think it just scared me becasue when I bought Bridget she did have a 1 year gaurntee. I was expectin the same I guess. No i really didnt expect her to replace a puppy, or spend the money on it, I just worried if something did go worng, I would somehow still lose out, and becasue the way I had been through it before figured a garuntee was standard.
