It sounds good, but it's going to cost all of us. Vets will have insurance rates rise because of this and in the case posted it was an animal shelter that is being sued, and of course, we pay for those too. Will groomers be more careful with our pets because of this? I hope so. |
Every time a litigant is allowed more to sue for, we all pay in the long run as insurance increases premiums to allow for it and the increases starting there spread wide and "trickle" like an avalance right down to you and me. |
Well if it continues vet care will get so expensive only the elite will be able to afford it |
I think it would be great if they allowed people to sue for punitive damages, meaning when gross negligence played a role in the death or injury. For example, all of those people who allow their dogs to run off leash, and who actually get into other people's yards and injure pets. Maybe if they knew this could hurt them financially, they'd be more responsible. |
I am sad that they lost their much loved pet. It is a sad story. I would like to see laws changed about dogs who attack and /or kill another dog. I honestly think the owner of the attacking dog should have to pay medical costs / plus if the dog dies wrongful death price of $5,000 on top of Vet costs. Emotional distress or suffering is too 'ify'. |

Difficult to say much on this until all appeals are exhausted and there is a verdict and award granted. So many variables....Was the dog wearing collar/tags? The dog clearly wasn't microchipped. They found the dog at the shelter when? And left it there until the following Monday so it could be microchipped? I don't understand this. If I found my lost dog, I wouldn't be leaving anywhere over what I'll infer from the article would be a weekend. Very strange. A large dog that's lived through a marriage, and the birth of a few children, is obviously up there in age. I'd think the life expectancy of the dog would come into play in the award of financial compensation. As with most sad situations with dogs, at the crux of it is the failure of people to maintain control over their pet. That dog ended up at the shelter because it was running loose...for whatever reason. That was a failure on the part of the owner to maintain control of their dog. Had that same dog while running loose bit another dog or person, we'd be having a whole different discussion. It will be interesting to see how this case plays out in the courts. |
I do think that people should be able to sue for damages when negligence plays a role. IMaybe then animal shelters and places that care for animals will be more responsible if they know that they could be sued. Maybe the dog was worth absolutely nothing to someone else, but that doesn't mean the dog isn't worth a lot to the owner. TBH, if my dog got loose and ended up at a shelter... I would not let them keep the dog to be microchipped. I'd take my dog right away and make an appointment. I would NEVER leave my dog over the weekend like that. I'd like to see what happens with this case. |

I am glad to hear this piece of news. I recently lost my dog to my neighbor's mastiff. Their dog buried a hole under my fence during the night. I took my 2 dogs out for potty in the early morning and one of them was grabbed by it. I was only able to save one. I cannot get the image out of my head. Anyways, I've called animal control and got the dog taken away. The owners weren't home since they were on a business trip. I am very mad and deeply sadden by this. There were no problems in the 5 years we've lived next to each other. I am not sure what to do since suing them would take a very long time, and being neighbors, it's hard to live hating each other. I am still waiting for the damn report which I submitted the request for public record to my county government a month ago. Neighbors relocated the dogs and offered to buy me another dog but I haven't respond to their offer yet. What do you guys think? |
To Wade. I would let them write the check for a new dog. They can't heal your broken heart. Your family has an empty place, and some doggy out there needs your love and good home. |
