Tater is in a holding pattern There is a glitch in Tater Jack going to live with Kellen in Maryland. Ashley sent me an email and then I talked to Chris (Kellen's Daddy) on the phone. It seems there is a new no pets clause in the apartments leases where they live. Chris said he signed a 5 year lease which didn't have the clause in it, so he thought they could have Tater Jack. Well it seems there is a new manager there with a very hard heart who is saying no way. Chris is sooo upset and so is his wife! Thank goodness they hadn't told Kellen he was getting TJ. Chris is going to go to the manager's boss and see if they can work this out! I suggested having his little boy's doctor write a letter that Tater is a service dog. Do y'all think they could get around the rule that way? Here's what I think we need to do: Pray that the manager will have a soft and loving heart for this child and his dog, and pray for Chris and his wife and Kellen. Apparantly Kellen is having some kind of allergic reaction today on his back and he is breaking out in whelps and itching. They are taking him to the doctor. I know God intends for Kellen to have Tater Jack and I'm going to "stand in faith" for that to manifest! Will y'all stand with me? |
Aw, I will be praying, after all that he has been through,, then some good happens,and now it might NOT happen, that would be horrible. I think the service dog is a great idea.. I think they should definately try for that. I hope this all works out, with a happy ending,, like we all wanted. :( |
I would do everything to try to get him to have the dog, and I think the service dog idea is a great idea! I will pray that this ends up the way it should!!! |
Thanks for posting these updates Elizabeth. This is such sad news. I still have my hopes up though - I think TJ would definitely qualify as a service dog. Not sure if I posted this quote, but after talking with Chris on friday he told me that when Kellen saw the pic and Chris said... what do you think of that dog Kellen? Kellen's response was, "I think that dog is the greatest dog in the whole world. And I really like his little red sweater." A truly remarkable kid! If anyone has any advice in this situation please please post here. Thank you for your help, kindness, prayers and thoughts. |
Yes I would make him a service dog. I'm sure the Doctor can help with a letter. We will all keep them in our Thoughts and Prayers. God knows we need a happy ending in this, I'm sure he will pull it off for us. Never give up hope! (((((((Tater Jack & Kellen))))))) |

This manager seems like a total a-hole. Isn't that the Grandfather Clause or something, that if something changed after you signed a contract or lease that you're allowed to abide by the conditions of your signed agreement? I'd think since they entered the agreement with the understanding that pets were okay that they would be allowed to have them through the duration of the lease. Where are all of our lawyers and law students?? My 1 class in legal contracts isn't helping too much here! |
I'm not quite sure exactly what the contract says - but I think there may be a clause where if you had a pet before the new rule came into play in 2005, that you can keep it?? I'm sure Chris will know more after tonight - Elizabeth and I will be sure to keep you posted on all changes! Thanks for your continued support everyone! :animal36 |
"What's meant to be will always find a way." I think it is very improtant that Tater have a red sweater when he gets to Kellen. Our Walmart here didn't have one. If anyone has a size small red sweater for Tater to have on when Kellen gets him, let me know. Kellen IS going to get Tater! I just know it in my heart! |

that isnt legal, just think about it, how could it be legal for someone to sign a contract and then stuff is added to it that you didnt sign for???? When they changed my lease (they changed it so we had to pay a $5 trash charge...... no big change right???) we had to sighn a whoel new lease agreement so that they could legally cover their buts for the $5.... making him a service dog is a good idea though :rolleyes: |

I really believe it was meant to happen, i don't think it all would have come THIS far, just to come to a screeching halt. I'm sure it will all fall in to place. I'll be praying that the little boy does end up getting Tater Jack. :) :love: |
I pray that the manager eases up a bit, and I think if they make him a service dog that he should be able to keep him there. Especially if no pets wasn't in the contract they signed. I know in my heart that TJ will get to that little boy! |

Elizabeth! Just saw this thread .... hope everything is already in order. I will absolutely stand with you in agreement that Tater is indeed meant to be with Kellen!! Patrick said that the terms in the 5 year lease are absolutely "binding" for the entirety of the lease! However, at the renewal, they can change it. I cannot imagine that anyone could be so heartless!! |

Here in CA, a managment co. can change the terms of the lease at anytime and the new terms apply to you.. They of course have to put that in the lease when you sign it though. If There is nothing in the lease about the management or owners of the property being able to change anything at will, they can't do it. But owners do have to make exceptions for service animals, especially if the person who is living in the home becomes disabled or ends up needing the animal AFTER they move in or they have to let the leasee out of their lease. So it seems to me that the family has many options and will end up getting that dog.. My fingers are crossed for them.. |
I really hope that everything works out and Chris get to take Tater home. I will pray for little Tater to go to his forever home soon. |
