I didn't get him from a breeder. I found him through an ad (he was from an unexpected litter) ... and was so lucky to find someone legitimate. But Kathy from Yorkiepals has been so nice to walk me through the whole process since the guy I'm buying him from doesn't know as much as a breeder does. |

Well I am super excited so I might be a little anxious haha ... I just wish we had a name for him! But I want to get to know him so we can give him a name that really fits him ... I really hope to find some locals though ... we want play dates when he's old enough!! |
I like your idea of waiting to name him. I think you're going to be able to find a lot of Yorkies in SoCal. We have several members from the area. No pup after all :( I actually lost the Yorkie I just bought because the man I was buying it from wants more money. We even signed a contract. He just never deposited my check and keeps saying the contract is just a piece of paper. I wanted to take him to court but it will end up costing so much more money. By the time any action happens, the dog will be older (we wanted a pup and we wanted to train him and socialize him in our own way) or it will be sold. Then what would happen? He can't do anything for us except give us our check back ... and it seems more worth it just to get a stop payment on the check and hope karma gets him back real hard. We are so heartbroken :( |

AWWWWWW i am sorry, He is so cute too and i left him a bone. I don't no about the states but here in Canada a contract consist of any party signing a legal binding contract. I think you should take him to small claims court. Also how much more did he want for the pup and how much was his asking price that you paid him. I am truly sorry. I wish you better luck. Don't feel blue your pup is out there just waiting to come home and love you and be your best friend. :aimeeyork |

that's so awful!! but bella's mom is right..if he signed a piece of paper saying you would get the pup for a certain price it is a legal binding contract and you should get what is yours..hehe i watch way too many court tv things!! |

About the contract, yes, we are definitely right. You should have heard the excuses that came out of this man's mouth regarding the contract: "It is just a piece of paper." "You can't sign a contract for a live animal." (Umm we both did) "What can you do? Sue my ass??" (Umm yes we can) Boy, I would LOVE LOVE LOVE to take this man to court. He has brought us so much pain and sadness. Today he dropped off the check to my boyfriend's work and said "can't sell the dog. He is sick." I really smell YOU KNOW WHAT. He tried to write VOID on his contract. *laughs* I guess he forgot I still my own VALID and original copy of the contract. I am sure we will prevail in small claims court ... but ... 1) It would probably cost too much (the dog would have been $900) 2) By the time we met in court, the dog would be older than we wanted it and we wouldn't want it anymore (especially since we wouldn't have trained it) 3) By the time we met in court, the dog would probably be sold and the judge would probably only order him to give us our money back (which he already did) 4) He is not a breeder so I don't think he can offer another pup I would ONLY go to court if I knew for a fact that I could get the money back for time missed from work and court fees AND that he would have to pay the amount of an equivalent pup (let's say if I found a male Yorkie for $1200, he would pay us $300 because thats how much more I have to pay since he violated our contract.) I have talked to a few lawyers (nothing where I paid them ... just friends) and they all said it is not worth it to go through all this trouble for a $900 pup that might get sick anyway (he was saying he no longer wanted to provide a health guarantee on the pup when he had promised to give us 3 months). This is just a horrible situation. I wished I could go on People's Court and let Judge Milian really give it to him! But it isn't going to happen. I did post an ad on Craigslist in regards to his ad asking people who were interested in his puppies to contact me. I think they would like to know he is not offering a guarantee and has his pups locked up all day alone with 2 large cats. I think they would also like to know the guarantee that breeders usually offer for just $200-300 more. They are probably paying that much anyway ... considering he is willing to go through all the drama of possibly getting sued for this transaction. In any case, thank you all so much for your kind words. I will still be around doing my research. I just need time to recover!! |
