My body demonstrates a phenomenon I have always experienced whenever I come into contact with the workings of natural law. I get this sensation, which is best understood as, the "willies." They just wouldn't stop as I read the updates. How very wonderful! We (me, the typist and editor and my son, the legal mind) are both extremely happy for you. I'm happy that I don't have to sit with him again (for hours) to share additional suggestions and thoughts. Aren't you the lucky one as my son would like to share with you...(hehe)... This is directly from my son: (Just as a reminder: as you may recall, I had included a "disclaimer" in the previous post regarding how what was said was not legal advice and should not be construed as such, that applies here.) Here I am again. I am not a member of YorkieTalk, nor am I like all of you (whackos-LOL-I do sometimes think my mom is crazy with this stuff-LOL) as I don't own a Yorkie (that's my mom's thing, not mine). But, she has gotten into this Yorkie stuff and enjoys this forum. One time in reviewing the forum, she came upon your situation and shared your plight because of her concern. I tried to help because I felt there were things which once you were apprised of could be helpful to you in your situation. I felt that the situation you faced was particularly upsetting for you; that seemed clear to me. I hope my initial post was helpful, even if it only boosted your confidence and/or was one of the driving impetuses behind your going to the woman's house and ultimate success in getting your dog back. After my initial post, thinking this matter was of significant importance to you, I had thought about what I said. I had come up with numerous other legal reasons, in addition to the ones already stated, and some comments on other posts and things people thought (e.g., how this seemed not to be a contract and there was reference to this "contract"). I could tell that you were quite concerned about what would happen when you tried to get your dog back and it was clearly a messy situation; however, legally, it seemed there were numerous reasons why you could get your dog returned (the ones I stated and others-at least 2 others came to mind-others which were in addition to and could co-exist with, not instead of, the other reasons (so you had numerous reasons)). Although, as you very well might be aware, even when the law is on your side that doesn't mean that what is supposed to happen, according to the law, does happen. You wanted the best outcome-your dog safe and well cared for and selecting a course of action which would guarantee that would occur would be very hard to do, if not impossible. It seemed like a very stressful situation. In this crazy world anything can happen-it seemed in this instance you needed a bit of luck on your side as there was no sure/guaranteed safe way to do this. I contemplated asking my mother to message you for your phone number so I could discuss this with you at greater length (because, as you can very well appreciate, the law can be quite complicated and it could be much more time consuming to cover in writing what could be stated in a shorter period of time verbally). I had stayed up and thought about your situation and was going to post those additional reasons and comments; however, before I could, and MUCH to my surprise, there was a post from you...and it discussed events which were surprising (like other posters, and yourself, I didn't believe that this lady would have ultimately been as nice as she was)...Ciera was easily and willingly returned to you...and as I read the post, I knew that Ciera was now SAFE with YOU AT HOME! : ) I am glad that this turned out so well for you. In legal situations, as you very well might know and/or read about, things often don't turn out good despite your effort. It is nice to see a situation, however rare it might be, end justly, fairly and "with the best outcome." I hope you are able to take care of your dog (I remember this whole thing started because you gave your dog away with its best interests in mind due to your extenuating circumstances and your inability to, as you felt, properly care for your dog). Based on my limited knowledge of this forum, and my exposure to it via my mom, it seems that there are caring and loving dog owners* out there who are more than willing to help you should you need it. So don't forget to ask for help if you need it, if you find yourself unable to meet your dog’s needs - Don't be shy, I'm sure members here will help you should you ask. In fact, there was a previous post which discussed helping you should you need assistance by having someone on this site care for your dog. Additionally, on this site it seems members give gifts to other members-care packages, if you will. I hear about this via my mom, this silly thing that is like secret Santa where people give others gifts. I hear her talking about these silly posts about this gift giving program where people guess things and she has a lot of fun with it. She has so much fun with it, she seems eager to participate in this silly gift giving thing---I think it’s quite ridiculous, but hey, this whole site is-it’s all about these furry teddy bear looking creatures (yes, she has one). But I do think if you need help caring for your dog, members here should send you something to help you out. I wish you and your dog well. Have fun with your dog doing the crazy things that you damn Yorkie people do. Good day! *(I, on the other hand, am not one of them-so don't ask me for any help-I think half of what my mom does regarding Katie, her damn dog, is over the top/crazy. But, I do have to say, recently as part of her craziness she wanted to try numerous types of dog food. I, seeing all these types had to try them, and I must say, some of them are quite delicious-YUM! So unless you are prepared to supply me with samples, other than those I have already tried (which I am unsure is even possible at this point considering the amount of samples we have here), I am probably not interested in helping you with your dog-LOL!). |
