Riley's gone!
 

2 weeks ago, I was met in the hallway here where I live, and was handed a 5 day notice to move or remove my Riley from the premises! It's because in May, while I was out walking Riley, he jumped up on a "guest/visitor", and she immediately said, "he just bit me! If he broke the skin, I'm going to the cops and reporting you to the office." I couldn't believe what she was saying, because I was standing right there, and Riley wasn't upset or anything. I did apologize profusely anyways tho, and she went into the building. To this day, I can't believe that Riley bit her; he just doesn't do that unless you're a kid being mean to him.
Well, I never heard back about it again, until the building manager handed me the eviction papers! She also said she's been "trying to reach me by phone, and by knocking on my door". This is not true, because I wear my cellphone at all times in my bra, because I have no pockets. And, if I were home, Riley certainly would've told me. I very rarely ever leave my apartment, unless I really have to, or Riley has to. The people who also live here are also livid...they all LOVE MY RILEY DOG.
So now, Riley is living with my son a few miles away, rolling in the dirt outside his trailer, being "one of the guys", and I sit here crying all the time. I'm just heart broken, and even though I know I can go see Riley any time I want to, I know Riley won't get the "proper" care he should have, even though I wrote it all out so my son could easily understand everything.
I want to have my Riley back sooooo badly, I'm even looking for another place to live who will allow me to have him there with me, but I need to have a subsidized housing unit, being that I am disabled, and cannot find any doable employment.
I'm going to see the county elderly and disabled helping people this week I hope. Oh, and the gal did go to the office and report me, and she even went to the cops and reported me! The report says only a small red mark was visible on her thigh, and it didn't qualify as a dog bite.

I'm sorry your heart is hurting. I hope that you will be able to find another place to live so that you can get Riley back. Just think of it as a set back...not permanent. Good luck!

That really sucks, why is the lady being such a bitch, and then they say they were trying to get ahold of you thats bs. I cant believe she called the cops for a scratch, he probably was just saying hello and she got all weird. I live in a apartment so that really sucks, and I too would miss my guy. I wish you lots of luck in finding a place to live

To the OP, could you try appealing the notice from the landlord? There must be some kind of protection for you. If the police report doesn't think the mark on that lady's thigh qualifies as a dog bite, can't you use that to your defence? Maybe you could also get the other tenants to sign a petition stating that they like Riley and want him to stay.

Hi, it's me again. I doubt it if a letter from my Dr would do any good...she said that she has to "protect " the others that live in this building also, and they shouldn't have to be afraid of anyones animal. NO ONE is afraid of my Riley, in fact, they all came "running" down the halls to see Riley when we were on our way out of the building.
I'm looking for another place, but we don't have that much available that allows pets in my area. My only hope is the County people I'm calling tomorrow morning. Apparently I'm not the first this has happened to. Wish me luck. I want my Riley back, even if I stay here. He was evicted for no good reason...and I did explain to her on the phone that I needed to have Riley here with me...She told me to "Stop being a baby about this!" and hung up on me.

YES, there is a way around this whole thing. I am very heartbroken for you. I am very sorry that this person is making it so difficult for you !
You live in subsidized housing, is this HUD ? any Subsidizized housing has very strict laws they HAVE TO follow> I know this for a fact, DO not be intimadated by them, and if you are legally disabled , you have rights .
If you are seeing a MD , Psych Dr. Therapist on a regular basis , then any professional of this nature can write a letter stating that a "service dog" is what you need , even in a no pet apartment complex. What it is under the American with disabilites act is a request for reasonable accomadation. It is not actually the landord who makes this decison, it goes to a higher authority, the "main people in charge" Under subsidized housing" their is always more people in charge then just the manager> You need to go higher up.
I also live in low income housing . I have a service dog for myself, and my son has one to. Therfore, we have two dogs in our apartment complex. My son is 16 yrs old, I am fully disabled he is high functioning autistic > I've been there .
Legally, the only way apartments or subsidized housing can deny a service dog is if it would make the insurance go up or they would have to change the structure of the building >Otherwise they can be sued for not allowing reasonable accomadations for a person with a disability a service animal to live comforably just like everyone else , under the ADA is a violation of the LAW .
Start reading your leagal rights , as a person with a disability and service dogs. I am certain it will help you feel a lot better. Please do not give up .You have lot's of rights. Riley deserves to be with you, and you deserve to be with Riley.

I was just starting to ask this when I read this post. Can't you have him certified as a service dog? If you can they have to let you have him unless they have proof that he did bite the lady.

I think I would also consider a petition of the other residence and ask them to write letters for you or sign a petition saying that Riley was not a biter but a friendly dog and how much they enjoyed him...... for when/if you get a hearing.

If you are on housing and you are disabled they can NOT refuse your dog if you get paperwork stating a " reasonable accomodation" , this is easly attained through your doctors office, being depressed is another reason you can have your dog!! Call housing ask for the paperwork to be sent out to your doctor.. call your doctor and tell them that you would like them to fill out the paperwork. No pets are allowed where I live , but I have a reasonable accomodation!! You can get Riley back expecially if you are disabled. FYI ;)

I really think you have a alot here to help you get your dog back in this apartment. If you have neighbors that have seen your yorkie often and can write letters and a police report stating on one red mark that didn't seem to be a dog bite, you have a good chance.

If you think in your heart it could have been a dog bite and not worth the hassle and you would rather move then that is one thing but I would fight it.

I owned my condo (now I am in an apt.) for 22 yrs. and the association had monthly meeting and it was rare that more than 5 or 6 people showed up even when they were thinking of raising the maintanence fees. One day we got a letter that we would not be able to get another dog if ours died and there would be a meeting on such and such a date. You NEVER saw such a turn out in your entire life. Yes, we had strength in numbers but they did change the law there as they wanted but grand-fathered us in so those that ones purchased when when it said we were able to have sm. dogs could still get another.

I know you feel alone in all this and I hope the advise you get will help you. All you have to do is run up against one person that doesn't like dogs and they can make your life hell on earth so maybe the move is best for you. Hugs, Joan

Unfortunately, landlords do have the last word when it comes to permitting pets on their premises as they are legally responsible if someone gets bitten or injured on their property. They also can evict pretty easily if a dog is just a nuisance, i.e. excessive barking.

Since Riley now has a bite on his record, right or wrong, I think it will be difficult to challenge your landlord's decision. I hope you are able to find a new place that will welcome Riley. I think I would try to get a doctor's note stating the reasons why you need Riley with you before you look for another place.

I would also be really careful next time to not allow Riley to jump on or bother anyone in anyway so you don't have to go through this again. Pets are always conditional in leases and subject to removal at the landlord's discretion.

Don't they have to give x number of days for eviction? In which case she should be able to keep her dog untill she moves out. This red mark on the woman's leg sounds disputable. If he's anything like Roxie he likes to jump up to people to say hello. I'm sure that's all he was doing. I know when I have shorts on even when her nails are clipped they can scratch a bit. He didn't know the woman was a biatch because he's never encountered anyone else that doesn't like him. You probably will be better off in a place where hopefully there aren't more of her around. Dog haters are miserable people.

I am so sorry you have to go through this. I don't know what I would do without my babies. Sometimes I can't sleep at night if they aren't all in bed with me. I hope you find a place that allows your Riley.

Definitely follow up with all of your options through ADA. Also, if you get enough people where you live upset about what the landlord did to Riley, there's power in numbers.

Don't get discouraged. Riley's getting an adventure vacation for now with your son, and she'll be back in your arms soon, you just have to jump through some hoops first.

I did overlook what happened > the bite accusation. The lanlord could have given you a 3days notice by law. Either get rid of Riely or evict. So 5 days was nice IMO. I've recieved 3 days before because of a cat. The landlord let it slide, however then anther tenant got one too and pointed out I had one, so I got busted . I was so upset . This was long before I was approved for a service dog.
Having a dog who supposedly "bit" a person is good cause for not allowing the animal back on the premisis. Best thing to do IMO, it to look for anther low income/subsidized housing and move. Then start over , request a service dog through your medical DR's and go from there. I am very sorry .

i am sorry to hear this i know how upset and hurt you may be because i get a little sad when i haven't seen my baby for a few hours. you will be in my prayers and i hope you get this straighten out soon than later.
