What would you do... I have Diesel and Daisy which they are both wonderful...However, recently my husband and I have noticed that Diesel was getting so much bigger (about 11 lbs) and he was very long and his bark sounds like a beagel...I didnt want to face the truth, but I let a friend that I recently met look at Diesel (she is a yorkie breeder)...She confirmed that he was definitely mixed with something, probably a maltese...I love him no matter what and am glad we have him...My question is...should I take the breeder to small claims court and get at least 1/2 of my money back. We paid 800.00 for him..I should have known better when she didnt let us go down to her basement where she kept her dogs...but I went with my heart and purhcased him...He is also registered with CKC.... This is tough situation because it's pretty much your word against hers... I mean, how can you prove that he really is a mix? You could call her and confront her, but chances are it probably won't go well.. Maybe someone else has a better idea... Good Luck! |
He looked like a yorkie when he was a puppy...But not too much anymore...I have some pictures we just took on vacation and I will post it as soon as I get home from work...She said the mother was 5 lbs and the father was 3-4...Is it possible for him to even get this big? There is such a big difference in appearance when he is standing next to Daisy... |
i dont know that taking it to small claims would do you any good.. |
How long ago did you get Diesel? And as Esme's Mommy says, unless you have a contract or papers in writing, most likely it's going to be your word versus hers, and it's hard to say what a judge would decide in that case... |
I am not sure what to tell you but I do hope that you work something out...and no matter what Diesel will always be loved!!! |
I would at least contact the breeder and see if she will right things. |

Ponyup, that is a good idea! It's not evil or coniving, I don't think anyways. Plus if it was taken to court, the judge could order for her to present the parents and all the paper work on the breeding animals, because there has to be a way to prove that she screwed you over! |
In some states it's against the law to tape a conversation without that persons consent. I'd look into it if I were you. Good Luck! |
Oh no. :( I remember watching Judge Judy one day and a lady took a yorkie breeder to court. The yorkie turned out to be like 20 lbs and even though it had yorkie coloring it had ears like a basset and curly hair. It was also CKC and the lady won her case against the breeder. There was no contract signed. It\'s something to consider. I would speak to a lawyer, though. |
I would be up front with the breeder and have her look at him. Yes, it is possible for small parents to have a large puppy...but I doubt the breeder was honest about the parents true weight. You said he was getting bigger, so I assume he is not full grown...with a 3 and 5 pound sire and dam, itis unlikely they would have anything over 7. Being CKC you realize they do not require purebred sire and dam for registration fo pups. You can tell the breeder you want a partial refund..if she disagrees try small claims..I saw a woman sue over an oversized Yorkie and she got a refund of half. |
In court, you would have to "prove" what you are saying. Another breeder saying that the pup was mixed would not be considered proof. |
I honestly think youshould talk to her and let her know that you are aware and very angry. However now that you are attached to puppy just keep him and save yourself the time and be glad that he is in your hands not in someone elses. I know the feeling it horrible when you feel cheated. |
