Translate that to a puppy sales contract and you are "guaranteeing" the puppy absolutely will not have a genetic disease. If you want to look at the technical effect of this one word--you are in breach of contract with all it implies. It's not possible to forecast the occurrence of all genetic diseases. Rather, your contract should "warrant" or state "to the best of my knowledge" the puppy will not have genetic defects. " so this is stating you can NEVER forcast all genetic diseases so you are already in breech of contract when you use the word "guarantee"? |

This is what my contract says: I, Karen ________, the breeder, guarantee to the best of my knowledge, that this puppy is in good health and free from disease at the time of purchase, and is providing buyer with a health certificate pertaining to this puppy. I guarantee that the puppy is a purebred and register able with AKC. I guarantee that if this puppy is found to have a health problem, within 7 days of purchase by a licensed vet, the puppy may be returned and (at my discretion) be replaced or purchase price refunded, or be returned to a healthy state and returned to the buyer. The breeder always reserves the right to take the puppy to her own vet, for a second opinion. Buyer agrees to take good and responsible care of this puppy, providing for shots and any other medical or physical care. I have read and understand the above contract and agree to its terms. |
