Co-Ownership? Hi to all of you! Iīm from Germany and I have a question to Co-ownerships. I bought a bitch in 2004 with a Co-Owning contract, that means I am the owner and the breeders are the Co-Owners. The daughter of the breeder had no driving license and as my dad is a driving teacher we said she should do the license with him. And the breeders get 2 puppies back ( females ) one per litter and of the first 2 litters of my girl. So how live goes it only took one year and they started to argue with us. Now my girl has her first litter, but she only has one puppy and that is of course female. Now my question is, do I have to give her back the puppy although it is only one? We didnīt put something about the picks in the contract. I also have to say in the contract is written that they have to give us a stud dog for this first two litters, but I had to pay for the stud dog myself and it where 1000 Euro stud fee. Have you got an idea what to do? Did you know about a similar case? I canīt wait to get some ideas of you! Simone |

My contract doesn't read as yours. As far as the 2 puppies back, I do know that alot of show breeders have it in theirs. Each breeder is different. I went back to my mentor/breeder for stud service. She was to have pick of the litter. I knew she wanted a female.....my girl had one. When it came time for her to pick, she looked at me and said, I would never take the girl puppy or any puppy for your females 1st litter. I will wait until the next litter. And she did, taking the female, but then placing her in a home of my chosing. She got all the benefits....she didn't whelp, I raised, she got the money My point is if you're working with a reputable breeder, most won't take puppy backs, when you are attempting to establish your lines. |
