What to do?
 

I need some help from Breeders because it's a breeder problem. My problem is that when i purchased Daisy from a breeder in Utah, she was to come with papers (link to original thread http://www.yorkietalk.com/forums/sho...ghlight=papers) it's now been over 1 year and I dont have them. Here site is up for sale and she doesnt answer her home or cell numbers. What do you suggest I do? Do i contact the Better Business Bureau? I've never been in this situation. I've told her I would contact a lawyer if she didnt respond (thought it might work). I've asked her if she didnt have the papers back then can she refund me some money, i've gotten NO responses from her.

You paid a lot for an unpapered dog so I can understand why you want them. If you can't make contact with her I don't know how you are going to be able to serve her to start court proceedings. Since you had her shipped I'm assuming you are not close to where she lives. Maybe post the city and state and see if someone could go there physically and try to make contact with her. At least you would know if you could serve her a summons, but then I don't know who would have jurisdiction over the case, her city or yours. So it probably wouldn't be worth traveling for a court date that could be postponed several times. If you can't report her to AKC I don't know what to tell you. Good luck to you I hope you are able to get the application for registration. Just a note, after approx. a month after the dog's first birthday the AKC tacks on a $35.00 late fee to the regular fees.

Another thought, did you pay anything by credit card? Maybe your credit card company could help you out, but after a year I don't know.

Warning for others purchasing a puppy, there is no reason why you should not be able to go home with the puppy and the application to register with AKC. The only excuse is the breeder being too lazy or too busy to submit the paperwork in a timely manner. If papers are important to you for whatever reason then do not take the puppy without the papers or withhold a portion of the money until papers are received (fat chance a breeder would let you do this though).

Can you give us her name and the city where she is located? I'm in the southwest part of the state and wouldn't mind checking in on her if she's near me. :) Janet

it's NOT abnormal practice withholding "limited reg papers" until a breeder receives proof of spay/neuter from the pet owners vet. It has nothing to do with being lazy or too busy to submit papers in a timely manner. It has everything to do with the pet owner living up to the spay/neuter contract they signed.

on your contract does it have the dam/sire reg #'s? if so perhaps call the AKC see if there is a litter registed under the breeders name and dam/sire reg #'s. They also may have an alterative contact for her other than what she gave you.

Certainly an unpapered pup should have sold for far less than a papered, you should be refunded some monies for her inability to produce papers as promised. If the papers are important to you take her to small claims.

The papers are only important to me because i was told i was paying for a registered pup. she's spayed, im not showing her, its just the point. im just so upset because i was lied too.

I would pursue her. Since her address is still current I would suggest to send a registered letter to produce papers or a refund of an amount that is agreeable to you within 10 days, if she doesnt respond file the small claims.

Unfortunately, Sandy is in the Northern part of the state. (which is a good 5 hrs. one way, out here in the west, distance is nothing like the N.E.) But, it's good to know the name of a breeder who decieves and has the gall to charge so much for it. There are other people in this forum from northern Utah, maybe one of them would be interested in seeing this set-up she has with all of these breeds. I'm familiar with the city of Sandy and it's all suburb. I'm thinking there's a possibility she's a broker. Even so, she's the one to go after, and I think you should. Hope she responds.

Did you have a formal contract of purchase? Did it say that in there that the puppy you are about to get is either AKC registered or is registrable (which means that your puppy is a recognized purebreed and has AKC registered parents)?

With respect to limited registrations, your breeder can't just withold documents without you agreeing to it. What essentially happened when you bought a puppy is a purchase contract where you were made a particular offer that you accepted. You paid money in exchange for the good, i.e., your dog. In order for you to demand something from the seller, you need to have an enforceable agreement that was violated by the breeder. It is not clear to me, based on your earlier email, 1) that there was a valid contract and 2) that this contract was in fact breached or violated by the breeder. Without 1 and 2, you can hardly demand anything from her legally.
