I've heard and supported the argument that contracts are only as good as the two people signing them and that is true. By the time you look to legal redress for contract breach, things have truly gone deeply off the rails.

One of the important things a contract that is written well and clearly does, is to outline the expectations of both parties. What happens if this situation occurs or that situation occurs. Of course one can't cover every teeny weeny potentiality but broad topics are clearly covered.

Purchasers who sign a seller's contract are well advised before signing to take that contract to their lawyer, so they truly understand the ramifications of what they are signing. There you can have the discussions of what this clause means or that clause. If you are okay with all of that, go ahead and sign, if not, then back to the seller you go with your concerns.

I also have a strict contract for pets and show dogs because I don't sell show dogs :)
My pet contract is simply put never rehome a pet I put in your home, it comes back to me! I will now place a pet in a home spayed or neutered.

I still would like to have an explanation of what the "open door" means as i still did not get it.
As far as contract i had an attorney hired to write and review all of our contracts from time to time to make sure we are legally bound all the way every time, and the reviews assure that even if some law changes from time to time our contracts are still legally binding ones according to the laws of our commonwealth. I feel this is very important. We do have different contracts for different situations , but the clause of never allowing re-homing of any of our dogs or puppies is always there, although we never had it happen. All of our puppies live in their forever homes... so far, so blessed !

From my understanding... "open door" means...any pup I sell or place...can always come's back to me...at any time should his owner no longer want him...NO QUESTIONS ASKED.
And in some cases..MUST come back to the breeder should the pet or show home no longer have the resources or disire to own and take care of the dog.

Someone correct me if I am wrong.

In my case i have the "must be return clause" on all of our contracts if the owner can no longer have the dog or do not want to, so pretty much i have an 'open door" than... good to know if i am ever asked...

Just as an aside.
When a contract is signed it is always a good idea to have the signatures notarized:)

And have a witness also.:)

Good idea, but not absolutely necessary as the notary is verification that the contract was signed by the ones who signed it.

I place all my pets spayed or neutered. There is no need to cover breeding with that.
All of my puppies go with a contract and in it it clearly states that in the event of needing to be rehomed the dog is returned to me. However, I have had 3 pups in the past that were rehomed without returning here. 2 of people called me and stated their situation, told me that they had found people willing to take the dogs in. I was given their phone number and names. I then called them, spoke at length with them, called their vets, and 2 references each. Then the dogs were rehomed. The new owners also invited me over and I went and personally met them. I told them that if there was an issue that the dogs in question would then come to me. They agreed and I check in on them all the time. The dogs are doing wonderful, one even seems to sense when the ladys' 12 year old is going to have a seizure :). But the last one was not so. I called to check on the pup every month for the first year and was told all was wonderful. On the 13th month I asked if I could come visit the pup on a message. No return call, happened each week for 3 more weeks. I then caught the woman at home. Long story short the pup was sold to another not so nice person. I went to that home and was able to purchase the pup from them for $200.00 and I did. That pup now lives next door with my neighbor of 12 years. So a contract is only so good if you do not check up on it.
I could anything in a contract. But without going and checking, not just calling, you know nothing. There are always people out there that are unethical, dishonest, and cruel. They know how to talk the talk and walk the walk. I try to stay one step ahead each time I place a puppy. But even I have been had. I am sure most have.
PS... I have an open door policy and even have one lady who just walks in without knocking and did this when I was in the shower once:eek::eek: Needless to say we had a chat and now she hopefully will knock :p

Oh my goodness- talk about a literal interpretation of an "open door policy". LOL.
