Need Your Help
 
Does anyone have a contract noting a clause which keeps any offspring of a puppy you are selling on a show prospect contract from being sold anything but limited registration with a spay/neuter contract unless the Buyer keeps them for him/her self or the original breeder buys one? I know that's a mouthful. I need something that will stand legally so I want to word it correctly. Please PM with info. Thank you. :)

Yep! Most of us do. My contracts state that all the show prospect cannot be bred until Championed. Any offspring produced by dog/bitch "specify name of dog/bitch" that are not kept by the buyer will be sold as pet only, spay/nueter, limited registration contract. This applies for the offspring produced by the first offspring, and 2nd offspring. So it is control over two generations. You can specify and write it the way you like.

Although, I've never had any problem with my show puppies....most of my buyers don't make a move without asking me.....

The contract specifies that the dog can only be used as an outside stud on bitches of my approval.

Thank you, would you be willing to share yours with me through PM and/or email? I am having trouble wording the portion about me being able to buy back pups from this dog. I was hoping to hear back from a seasoned show breeder. Much appreciated!

My contract was drawn up by a lawyer....so, the only people that see it are my puppy buyers......

Easy but, let me ask are you wanting first pick of offspring? Cause that can be tricky and unfair to the buyer....after all they are buying a show dog in hopes that the dog will produce future Champions for them.....and if you want first pick I don't think that would be fair?

No, not at all. I just want the pups that are produced by this puppy in the future to be registered limited, unless I ever choose to purchase one out of a future breeding to breed back to my lines, as I am keeping females out of my sire as well. When this puppy is championed I do not retain first pick on his litters. I do understand that yours was drawn up by a lawyer, I will look into this myself. Thank you.

I've PM'd you with some wording. I know that when you word this it's somewhat tricky but, you must leave nothing to chance or open for their own interpretation......

I would like to offer a word of advice that regardless of what contract you might have, how ironclad it might be, be way more cautious of who it is you are trusting on open papers or for that matter, even pet only limited registration. If something goes wrong and the person goes against your contract or intent, are you willing to drag them into court and the expenses and headaches involved?
IMHO, it is much easier dealing with someone you know you can trust and the contract is merely a reminder on what both buyer and seller are agreeing on.

I've only placed one show and I trust this woman with my life. As a matter of fact I'm handling the boy to Championship.

I was just thinking about you. You are so right.....a contract is just as good as the 2 people who are signing it.

Over my dogs, yes I would absolutely take them to court. But, you are right, the only way to ensure that your dogs and your lines are safe is to spay/neuter them before they leave. Sad, but true.
