Oreo's Law to be Re-introduced
 
Some of you may remember Oreo's Law, named after the dog that was rescued then killed by the ASPCA. Efforts to pass the bill failed last year but it is being re-introduced this year. The new wrinkle is that, along with the ASPCA, Best Friends opposes this law. It seems unfathomable that this group would align itself against this bill in light of the work they do, but it is apparently so. It is the subject of some discussion with the No-Kill Advocacy Center. What's really odd is that Best Friends and the No-Kill Advocacy center have been working together in the past but that seems to be over now.

Here's Best Friends' statement. It's from last year and my understanding is that their concerns were addressed in the new bill, yet they still oppose it...thus the fighting among groups. BFAS Statement On Oreo's Law | Facebook

It looks like a permanent rift is coming between some of these groups, and it seems centered around money and political clout. This is very distressing to me as I have always admired Best Friends. I will say that my eyebrow got raised recently when I read they took in $43 million in one year. I wondered then if their mission was big enough to properly use all that money. I will definitely be taking a longer look at this group.

Back to the point of this thread....Oreo's Law is being re-introduced and needs the support of everyone to help it pass. Here's a link with the new text of the bill and (at the bottom) a couple of web addresses of Congressmen to contact. Save Lives - Pass Oreo's Law: Feb 11, 2010

Interesting, Jim. Thank you for posting this.

I can't really read Winograd's writings on his own site, bc he's too emotionally charged for me - and his emotions somehow get in the way of the content of his articles (for me).

But, in one of Winograd's article links you posted, he did link out to an article he wrote for the Examiner (here) and I thought this was a very well written and informative article! He's a much more powerful writer when he tones down the emotion (maybe he should hire whomever his editor was for the Examiner article :D).

This really is concerning. If this concerted effort to defeat Oreo's law is as self-promoting and selfish and repugnant as these articles indicated -- then, I feel the same defeat as when our decisions in D.C. are made upon party lines, rather than upon content. UGH.

This is really disappointing to read, but it's important information.

I hope some of the rescue folks on YT see this, bc it'd be interesting to hear their firsthand account regarding rescuing dogs from shelters.

I'm thinking I'll write some letters to Best Friends, ASPCA etcetera. I wonder what else could be done. :confused:

Ann, I agree with you on this. It all starts to reek of partisan politics. Has our animal welfare movement become about power and control?

Nathan Winograd can come off as a little strong, but I think it's born out of frustration. As I mentioned earlier, Best Friends and No Kill Advocacy Center (Winograd's group) have worked together in the past and I believe it's painful for him to see things come to this. JMO and I am one that really believes in the No Kill movement.

I did look around for other sources of info, but we have to take what's there. My question would be...is this true? I just look past the editorializing and try to see the crux of the issue.

I also would like to see what some of the rescue people here think about this. It is rescue groups that are being mis-characterized to further an apparent agenda.

It's really a shame...because all this infighting does nothing to help the animals...which is what it's all SUPPOSED to be about.

Okay, I'm beginning to see where this animosity between the No Kill Advocacy Center and Best Friends comes from. Apparently, as of last year, Winograd believed Best Friends was on their side and Best Friends was a key player last year.

Here are a few quotes from a Winograd Article from last year that illustrate this.

1. "No Kill Movement United Behind Oreo’s Law

Not only have thousands of animal lovers contacted Kellner and Duane thanking them for introducing Oreo’s Law, but the leaders of the No Kill movement have unanimously embraced it as well. Louise Holton, Trap-Neuter-Release (TNR) pioneer, Alley Cat Allies co-founder, and head of a national cat rescue group, was the latest No Kill leader to embrace Oreo’s Law, urging New York legislators to pass it.

She joins:

* National leaders including myself at the No Kill Advocacy Center and Michael Mountain, founder of Best Friends;"

"In fact, Best Friends Animal Society asked New York State rescue groups whether they supported the bill, and whether they have seen animals killed by shelters despite their offers to save them, and the overwhelming response was “Yes.” (When Best Friends presented these findings to Ed Sayres, however, he dismissed them as irrelevant.)"

"Nonetheless, activists working with Kellner’s Office approached the ASPCA this week, through Best Friends as an intermediary, in the hopes of removing Sayres’ opposition to the bill, and offered additional (though unneeded) protections and a face-saving change in the name of the law in exchange for the ASPCA’s support,"

It certainly appears that Winograd believed Best Friends was working to pass the bill. This doesn't seem to be the case, given the way it actually played out. Here's this....

"During the very public discussion of Oreo's Law, Best Friends remained remarkably silent on the subject. However, following the tabling of the bill, various sources made statements indicating that Best Friends had actually worked behind the scene to kill Oreo's Law. When the bill was being discussed by the Agriculture Committee in the New York Assembly, it has been reported that the lobbyist for the ASPCA told legislators that Best Friends Animal Society actually opposed the bill. She also was reported to have told them that Best Friends was afraid to anger their animal rescue supporters by opposing the bill, and that their "neutrality" or "silence" on the topic should be interpreted as opposition.

Best Friends Facebook page was deluged with complaints about their failure to make a public statement regarding Oreo's Law. In a late-night attempt to quell the discontent, they published statement indicating they had been "neutral" on the bill. The statement only seemed to anger many of their members more. They released a follow-up statement shortly thereafter, apparently explaining why they actually opposed the bill (Huh? I thought they had said they were "Neutral"?) In this later statement they wrote, in part: response.

"The Hayden Bill in California is often cited as a shining example of shelter access legislation, but it does nothing to address these kinds of situations and they are more prevalent in California than proponents of the bill are either aware of or willing to admit. In the last 2 years alone Best Friends has been asked to intervene in 267 hoarding situations affecting over 19,000 animals. Of those, 49 have been in California, 7 more incidents than the next three states combined."

As a reminder, Best Friends opposition seems to be centered around the argument that rescues can be hoarders, which has been shown to be untrue.

I don't want the infighting to take away from the point of this thread (though it's my fault for bringing it up). The important thing is that this is a VERY worthwhile bill that needs everyone's support as it was defeated last year.
