I agree. He sleeps the whole time you are gone anyway. Even though he is lively and energetic, it will not hurt him the least bit to be confined in a crate while you are gone. I'm afraid this is the only way you can prevent him from going potty inside while you aren't home. Make sure the crate is only big enough for him to stand up, turn around, and lay down.
