  You should get your deposit back no question about that.  If not you should be first to get a puppy from the next litter. I read through all the emails in this thread and then realized this breeder told you she has three families waiting for her next litter which is December.  DOes that mean they will be born in December?  She must have some crystal ball to know how many puppies will be for sale in December.  Have they been born yet and aren't ready to go until then to new homes?  For a litter to be born in December the breeding would be October, is the dam allegedly bred or being bred in heat yet.
Hmmmmmmmmmm could smell like a scam alright. 
I do not take deposits as I seldom have anything for sale anyway and don't know when I could sell a prospective buyer a puppy.  If a situation arises that I do take a deposit, I always will refund it even if the buyer backs out.  I don't want my puppy going to someone that changed their mind anyway so have no reason not to return the deposit.If I have Vet bills or other money trouble, that's my problem not the problem of the buyer of my puppy.
