Agreed. In Florida, it is illegal to sale puppies under 8 weeks of age. See:

Also, there is a puppy lemon law that if the breeder misrepresents the health or breed of the dog, as certified by a veterinarian, the puppy can be returned for a full refund. See:

The puppy looks like a terrier mix of some kind, but not a Yorkie.
If it were me, I would call the police and try to have this breeder shut down.
