Animal Smiley 049 Should breeder be responsible for cryptorchid?????

I really need help!!!!! I purchased a yorkie male from a breeder : I thought was a friend (Boy was I DUMB!). She knew I was looking for a tiny male and while we were talking she said she had a wonderful tiny guy. I was wanting him to use as a breeding male to my 2 females, and she knew this. At the time of purchase she gave me a copy of her stud contract to use when the male was used for stud. I ask her what would we do if something were to come up if he couldn't breed. She was smooth, she said we'll figure it out when the time comes. So she got my money.
When I took him home he was crusty with flea crud, ear mites, worms of all kinds. The vet checked and treated him for all listed. I called to tell her about the puppy, and her answer was: It is dirt from where he was playing outside. She had to tell me that she is so good with he puppies her vet always recommends her to anyone looking for a Yorkie. Her vet told me this was untrue as they never recommended her. The story only gets worse.
I contacted her to let her know that only one of the testicles was coming down, what could she do. She said give him time as yorkies are slow to develop.
Well he has only one testicle. I've had him to 2 vets and they say its a defect that can be passed on. I have called her to request that she replace
the dog or refund my money. After a year of hearing she doen't have any male puppies, she doesn't have any females bred(she has 9 females I know of and breeds every heat cycle), and she can't guarantee a male to have 2 testicles (She said B-lls).
My proven female was in again and I had tried to breed him twice with the male (he was old enough to breed) at her request: that just because he had one testicle didn't mean he couldn't produce. Well he couldn't, and can't.
So my final attempt was to contact her and ask if she had any puppies,
NO. Well did she have anything I could use. Yes she had a male (she had bought him back for 1/2 of purchase price. He was 1 year old and 1/2 brother to the male I had. So I thought HUH! we'll she how far we can go with this. I ask what she wanted for the male and I just needed to come look to see if I liked him. After getting this answer again. I got my courage to ask what she could do about replacing my male with the male she was offering me forsale..... She told me that she couldn't do that the dog was promised to her son. She did offer me one stud service and she would take my male back. Big offer for me. I'm out the money and she wants more.
I've since filed a lawsuit in smallclaims. So what I need from you all is answers. Shouldn't this breeder be responsible for this male?????
