It could very well be the Mommas fault but at least the breeder should be doing a necropsy on one of the pups. Failure to thrive is something that often (but not always can be noticed) - for eg what did the daily weighing in of each puppy tell the breeder about weight gain? Was it stable and constant? What were their activity levels and did they progress normally through the stages of puppy growth?
A simple question is the breeder knew your pup and at least one other was not doing well the day before - why then did he go to work the next day - without someone in place at home to respond to an emergency???
