The contract covers life threatening conditions and specifies return of the dog. Indiana doesn't have any puppy lemon laws in place. Both parties signed the contract and agreed to the terms. It's highly unlikely that any judge would do anything other than enforce the terms of the contract, which would mean Max would be returned to the breeder and the money paid for him refunded. If reimbursement of medical costs weren't covered in the contract, then those would be lost as well.

We have an unfortunate situation that wasn't covered by the contract. We may all have our opinions about what we think the breeder should do. But to be honest, after reading some of the comments on this thread, the last thing I would be doing as a breeder is responding on here. I would be seeking legal counsel.
At this point, all I can say is that according to the rules of the YTCA that Gemy posted, Judy broke those rules, sending home a sick puppy.

My mistake? Believing what Judy told me on the phone, when we 1st spoke.

And my husband and my mistake-believing her when we made our 1st trip to see the puppies when they were 12 weeks old.

But over 30 years, I have bought 3 beautiful Yorkies from wonderful Show breeders.

Never a problem.

There is more to this story, so I will try to be brief and to the point.

Judy misrepresented this puppy from the start, sending me a picture labled gustos mom, stating she is the Mom.

Found out she is not the Dam.

Also told us that she imported the Dam-not true.

Claimed she is bad with pictures. But sent that same picture to a friend of mine.
