You have all the tools and experience to evaluate what is best for him for the future. The place he's in now may or may not be appropriate, and Mary's situation now may not be best for him either. One vet has already commented that his teeth are in bad shape, so a dental is needed asap.
BTW people who are judging his feelings or condition by the one photo received may be jumping to conclusions. We can't know for sure that he is sad. Actually if you look at photos of Yoshi in his album he had a similar look in 2008, and people remarked he looked tired. See more here:
