Joey I am not a lawyer nor a vet, but from following the history on your thread I would suggest that you do have a case.
7 . The illness or injury was not contracted post adoption, and you took great care of Joey.
9. If the reason for the illness were a parasite ( .??? ) , 1) the pup is certainly critically ill. And 2) if the parasite was in the pup prior to adoption ( as I would think it was, from the mother/fleas etc) then the breeder should be liable. As for the hypoglycemia, I think the health issue most probably caused it....not any inaction by the adoptive mom.
The last para would give you a refund of the cost of the pup only, not the vet fees. If the dog is not going to survive, God forbid, it looks like that is all you will get. Very inadequate I know. In that case the pup should be returned to the breeder alive to be assessed. Not a very comprehensive or generous contract!!
When this is over, hopefully with Joey well again, perhaps you should give the breeder's name here so YTers are warned. This is not a compassionate or good breeder in my view? Again prayers for all involved. |
