That judge must be stupid
.If a car is not totaled you absolutely have to pay to have it repaired it is only if it is totaled/dead that you get the exact value of the car. I know when the guy rear-ended me it cost a few thousand to replace my back bumper,rear windshield and fix the paint job and that was on an older car. If they want to get legalistic their property damaged someone elses property so they need to pay to fix it.
