Notice it says "one of the following remedies selected by the purchaser." It does not matter if she says she does not give refunds. She is still bound by the law of the state and must pay the vet bills up to the price of the pup, if that is what you decide. You may have to get some legal help to make her come up with the money but it is cut & dried so I would just sue her pro se (by yourself in small claims court) if she doesn't give you the money.

I have no sympathy for these dealers who put too small, too young, and too sick puppies on airplanes and send them to unsuspecting buyers who deserve to receive a healthy puppy for their money. Receiving a sick puppy is so much more of an emotional issue than receiving damaged merchandise! But the laws are sort of the same. The seller must make it right -- they either give a full refund if YOU want to return the puppy, or they pay the vet bills up to the price of the pup if YOU decide to keep the puppy. I get the idea from your posts that you will keep the puppy no matter what and I am glad to know that. This breeder is not someone I would want to send a little pup back to and I definitely would not want a replacement pup from her.

Always check state laws in ADDITION to the contract provided by the breeder. I see contracts in Florida all the time that are in direct opposition with what the state will actually require! They think if they tell you they won't do something that will be the end of it. For most it is too. But if you read the law -- that is what they must abide by. Good luck with your little one. I love the name as my middle son is named Kyle and I used to do a silly sing song thing calling him Wiley, Kylie Coyote. After he got into the Roadrunner cartoons, he said he didn't think he wanted to be the Coyote. But I told him everyone has a little heart going for the coyote, no matter how many times that Roadrunner wins.

Thanks for naming names too! People need to know things like this about a breeder. I will follow the thread to see if this breeder will abide by the law without taking her to court or if she is so uncaring that she will have to be forced to do her part for this little pup! Wishing you the best!
I have a 17yr old son named Kyle. He is the one that actually named Wiley... I give him all the credit!!! Wiley took to him right away the day we got Wiley. Slept in his arms on the drive home. My other two kids are 12yrs & 7yrs. Wiley didn't want much to do with them the day we got him. Now... Wiley loves attention from all of us, but he runs to me first...
