Yes, you are definitely under warranty. You can call tech support 1 800 275 2273 and they will gladly help you, or make an appointment at your nearest Apple Store and one of the geniuses will help you. The iTouch is a great product and I'm sure it can easily be solved. BTW, you might do yourself a favor and buy some Apple Care Protection which will cover you after the first year's warranty runs out. Well worth the money!
