I'm sorry for the loss of your baby. I think Chachi is probably right. The burden of proof is going to lie on you since your baby was killed in their yard rather then yours. I know it's closing the barn door once the horse has escaped but I would look into securing the fence better. We had a neighbor who had a pit and a rotti and we only had a cyclone fence. I ended up leaving the cyclone and also installing a 6 ft stockade all the way around the cyclone for double protection, leaving a small gap between the two so there would be no way for them to make contact. They have since moved and we now have them replaced with another person living there with a large pit/lab mix who they allow off the leash in the front yard. Now, we have to find something to do with the front of our fence so that he can't wonder over and get a hold of their faces through the fence. Very frustrating when you have small dogs who fit through tiny openings. Again, I'm sorry.
