So sorry for your loss. I don't know anything about US law. In the UK it would be a civil matter. But if the dog was found to be dangerously out of control the owners could be prosecuted. Its something nobody ever wants to go through and I think it has been made worse, if it could be so, is that your neighbours are not accepting what their dog did and haven't even offered to pay any compensation.

As for the fence, if it is a dangerous dog I would certainly get it fixed so that the dog couldn't possibly get near your children.
