I think the most she could be charged with is fraud, however, one of the definitions of fraud, is "promise of future performance made with an intent, at the time the promise was made, not to perform as promised" You have to prove that she never intended to pay, Yorkietalk when she first made the offer. I doubt if that was her intent. I think if this had been an outright scam, there would never have been a cookbook delivered. While I don't condone what she did, I think she got in over her head, and her personal financial difficulties, lead her to rob Peter to pay Paul. Unless there was some type of contract with Yorkietalk, I doubt if there is anything that can be done. |
