I personally never sold anything that the condition was questionable. If it isn't excellent...I won't list it.
You can file a dispute, but you will be responsible for returning the item if the seller requests it...at your expense. Your seller will have 10 days to respond before paypal sends it to resolution. So be prepared to wait.

Its dirty, but its still good used condition. It does come down to a matter of opinion.
