Where do you plan to have him sleep at night when he's not in his expen? I wouldn't let him sleep with you until he is reliably potty trained. Our bedroom is upstairs and we have always left Franklin downstairs at night.
I think you would absolutely take him to his potty area first thing in the morning. It shouldn't confuse him anymore than rushing a dog outside first thing in the morning.
