I'm sure there will be waivers for dogs that are at a high risk for undergoing surgery...those that are too small or have a health issue that would make surgery too dangerous. Same as there are for rabies laws..you can get a waiver for the rabies vaccine if you have a good reason. So far as the size issue though, I've heard of even hamsters being spayed/neutered so I really don't think any dog is too small...I know I would be a lot more nervous if I had a tiny dog but I'd still have it done if they were healthy
