Yorkies originally had flop ears and they were cropped to make them stand. It's not that unusual 150 years later to find one that just doesn't want to stand. If the ear leather is large or thick and the cartiledge is weak it may be more fight than it is worth to get them to stand. Since he is a beloved pet and cute as a bug with his ears down I say let them be if you want. Make sure that they are kept clean and dry and enjoy his forever puppy look.
