You have to train him more, let him know that you are in control.
Have you tried wee wee pads for his toilet needs? Perhaps you can use them under the bed for a while and then move it out into a corner of the room.

you sound like a nice person who can tolerate these little things, the person you sell your pup to might react different and be nasty to the little guy.

That's what I'm afraid of....someone won't be as patient with him as I am so, I think its best I keep working with him. You said your last yorkie was hyper....did you do anything like medication? I know a vet here in town presribes medication if the dog tests positive for hyperactivity.
