I agree. I think we need to cut Kim some slack.
Kim, what I would do (since you and no one you know can keep the Maltese) is simply bring it to a rescue or a shelter. SOMEONE will eventually adopt it and at least while it's waiting for a new home, it will receive medical attention, food and a bath. Plus, it will be walked and not cramped in a tiny cage. That is definitely a much better environment than the one it's in now.
