I would send it back. Even buying through Cingular I have had to return two phones over the years. I have also bought one off ebay that has outlasted 3 phones. When my son has trouble with his current model, he always goes back to that cheap ebay phone til we can get him a new one. I think they are all a gamble -- as long as the plae you buy it is willing to make good on a warranty, all is good.
